New project may prohibit to use payment cards for gambling in Brazil

Instead of moving towards an open and regulated legislation like the rest of the world, some Brazilian politicians just think of banning. Now a project that may help curb the use of debit and credit cards for gambling-related transactions is scheduled at the Committee on Economic Affairs (CAE) meeting on Tuesday (16). Under PLS 121/2008, the Central Bank (BC) and the National Monetary Council (CMN) may set rules to prevent online betting.

The current drafting of the bill is by the rapporteur Senator Davi Alcolumbre (DEM-AP), who presented a substitute to PLS 121/2008, by Senator Magno Malta (PR-ES).

The rapporteur has modified the original proposal to extend the powers of the BC and CMN provided for in Law 12.865, of 2013, which regulates banks to issue and accredit payment cards.

Modification

The original text prohibited credit and debit card transactions involving gambling and, in case of noncompliance with the rule, submitted the card administrators to the Consumer Defense Code (Law 8.078, of 1990).

The proposal was rejected by the Commission for Science, Technology, Innovation, Communication and Information Technology (CCT), which it considered as excessive to assign payment card managers the task of identifying the nature of the transaction between suppliers and consumers.

Alcolumbre chose to give the National Monetary Council and the Central Bank the power to regulate the issue.

"These authorities have in-depth knowledge about the financial industry, and monitor it continuously. The route of regulation may be better suited to provide an efficient response to this type of problem," noted the rapporteur.
