“There is no reason to keep gambling banned in Brazil”

Igor Mauler Santiago, a tributary and member of Sacha Calmon-Misabel Derzi Consultores e Advogados, wrote an opinion column for Estadão last weekend where he defends the legalization of gaming in Brazil. “The reasons are job creation, tax revenue, attraction of foreign tourists, retention of Brazilians who travel abroad, promotion of the hotel and artistic markets, etc.,' says Mauler Santiago.

Pretending the freedom of the citizens, whether to undertake, to give their time and money the use that best suits them, I am of the opinion that it is not the case to align reasons for the liberation, although they exist: tax revenues, attraction of foreign tourists, retention of Brazilians traveling abroad, promotion of the hotel and artistic markets, etc.

The line of reasoning must be different: do the grounds for prohibition apply? The answer is no. The risk of gambling being associated with illicit conduct (drug trafficking, exploitation of prostitution, etc.) is greater in the current illegal casinos scenario than after liberation, when enforcement would be institutionalized. In addition, most players are not users of drugs, and many travel as a family.

The possible use of the money laundering activity does not justify the interdiction, or we would have to extinguish the markets of art, animals of race and many others. The possibility of inducing addiction in a minority - which deserves respect and care - is not enough to prohibit an activity practiced by the majority within the limits of recreation. To validate this reasoning, what measures would we have to adopt in relation to alcoholic beverages?

Finally, if these objections were serious, how would the exploitation of certain games by the federal and state governments be explained? In short: regulation yes, no prohibition.
