Decision prevents seizure of material at Brazilian bingo room

After having computers, monitors and other equipment seized by the Military Brigade, the owner of a bingo room in Santa Maria, Rio Grande de Sul, filed a writ of mandamus asking police authorities not to seize the equipment of the venue. Last Wednesday, Judge Leandro Sassi (2nd Criminal Court) granted the request and ordered that the police authorities not to seize the materials from the place.

Last week, on the night of the 26th, the Military Brigade was in the gaming house and seized 56 CPUs, 17 televisions and a machine that raffles the numbers.

In a decision of the 2nd Criminal Court of Santa Maria, the request was deferred, that is, it was attended. Last Wednesday, Judge Leandro Sassi, who is acting as a substitute in the 2nd Criminal Court, granted the request and ordered that the police authorities, in an eventual operation in the venue, not to seize the materials. The rule says:

Therefore, in the light of the legal requirements, I DEFINE the request for preliminary injunction, in order to determine to the authorities pointed out that, in the event of a possible police operation, they abstain from practicing any act of seizure and / or confiscation of equipment used in business activity including electronics. Sign up / notify the authorities appointed as co-rapporteurs, to provide information, within the legal deadline. The Prosecutor's Office and the Prosecutor's Office were summoned at the conclusion of the injunction.

To local media, the judge explained that the gaming house was opened according to the administrative procedures and that, even, the State collects taxes from it. He recalls that police recently visited the site and collected the equipment without judicial authorization from a place that is operating regularly. Sassi recalls that he decided in a similar way in another case of jogo do bicho, and that other recursal groups have welcomed the decisions. For him, the judiciary must observe other more serious cases.

"If the State understands that this type of place can not function, take action to do so, either by closing them or by acting in another way. Criminal law is not the right scope for this because there are many more serious crimes that should be attended," explained the magistrate.
