Judge cancels decision that allowed gaming house Winfil

An order from the 3rd Civil Chamber of the Court of Justice overturns an earlier ruling by a judge, which released the Winfil gaming house, a luxury complex recently opened in the southern area of the capital of Rio Grande do Sul state.

The gambling house came into business allowing cash bets about two weeks ago. It acted thus supported in an injunction decision of the judge Viviane de Faria Miranda, of the 3rd Court of the Public Treasury of Porto Alegre.

The magistrate accepted a pre-trial order filed by Winfil's owners to prohibit the Civil Police and the Military Brigade from seizing slot machines.

The judge ruled: "I defend the preliminary injunction in order to determine to the authorities indicated as prosocial that, in the event of a possible police operation, they abstain from any act of seizure and / or confiscation of any movable property that lodges the headquarters of the including electronic equipment. "

Later, another judge - Márcia Kern, from the Special Criminal Court of Tristeza - authorized the Civil Police to seize money in the devices within the slot machines, on the grounds that bets on gambling are prohibited in Brazil.

The gaming house remained in a court clash, appealing against the decision, as well as the Public Prosecutor's Office, pressing for the definitive closure of the gaming house. It was then that the judge Eduardo Delgado, of the 3rd Civil Chamber of the TJ, decided by the nullity of the decision of Judge Viviane Miranda that released Winfil for operation.

Delgado considers that gambling is a matter for the criminal justice system and, therefore, has determined that it is appreciated in the Special Criminal Court. In addition, it decreed "the nullity of the aggravated decision, as it proclaimed in the judgment of the Third Court of Public Finance." For the Attorney General, Fabiano Dallazen, Winfil will continue for a long time forbidden to explore gaming.
