Brazilian gaming law could go to Senate vote in the next two weeks

Senator Benedito de Lira read his vote in favor of PLS 186/2014, which authorizes the exploration of games of chance. President Edison Lobão, responding to requests, gave a collective view and the matter will return to the agenda at the next CCJ meeting. The project provides for the opening of the entire gaming industry and the request for views is so that everyone can have complete knowledge of its content. Thus, it could be scheduled for voting in the next two weeks.

The report by Senator Benedito de Lira foresees the levying of taxes on bets to be made even through mobile applications. The collection would be divided between states and municipalities. According to the report, bingos and video-bingos will stay with the states and jogo do bicho with the municipalities. The Union will be responsible for sports betting and online gambling.

The senator has filed an amended version of PLS 186/2014 that radically reforms plans for the country's gambling market, authorizing everything from land casinos to unspecified forms of online gambling.

"Finally, it is necessary to remember that gaming has always been part of the imaginary of the civilization, they are the origin of the culture. Therefore, they are not outside human nature, being part of it. In addition, the long period of prohibition in Brazil, about 75 years, ended up by mistakenly labeling this activity as a moral issue, including, contaminating the debate about its legislation. The proposed measure, therefore, intends to withdraw gaming from informality and illegality, allowing operators to become entrepreneurs that can contribute to Brazilian economic activity, while promoting an increase in the collection of taxes for the country," says the application.

The PL186 / 2014 is authored by Senator Ciro Nogueira (PP-PI) and was unanimously approved by the Special Committee on National Development in November 2016. But in December the text was sent to the CCJ after approval in plenary of the request made by Senator Magno Malta ( PR-ES).

The House of Representatives has its own gambling bill, PL 442/1991, which Mayor Rodrigo Maia promised to vote in November. The two bodies will eventually resolve the discrepancies between their respective proposals and, while the momentum for consensus seems to be growing, Brazil's frustrating political climate makes any prediction a bad bet.
