Project regulating gambling in Brazil is on CCJ's agenda

The project, which authorizes and regulates the exploitation of 'fortune' games, both face-to-face and online, is once again on the agenda of the Constitution, Justice and Citizenship Commission (CCJ) tomorrow (Wednesday 13th), and the analysis promises to generate many debates. Last week, a collective request for a more detailed evaluation of the text was requested.

If, on the one hand, author and rapporteur -Ciro Nogueira (PP-PI) and Benedito de Lira (PP-AL) respectively- defend the need to stipulate a regulatory framework for the exploitation of these games in Brazil, some senators can not see as well as the decision of legalization. Nogueira and de Lira take into account the historical-cultural aspect of the games and the relevance of their social function to the country.

For Nogueira, it is necessary to abandon the demagogic discourse and recognize that the prohibitive legislation did not change the scenario of illegality of gaming in Brazil, which moves annually in clandestine bets more than US$ 5.5 billion with the jogo do bicho, bingos, sports betting, e-gaming and internet poker.

Benedito de Lira also points out that gaming have always been part of the imagery of civilization, they are at the origin of culture and, in Brazil, were labeled "mistakenly" as a moral issue, which would have contaminated the debate about the legislation of the activity.

The text of PLS 186/2014 contemplates the regularization of jogo do bicho; video-bingo and video games; bingo; casino games in integrated leisure complexes; sports and non-sports betting games; online casino games. Accreditation for the operation of the bingo and video-bingo game will have a 20-year term, renewable for an equal period, and will be the responsibility of the states. The accreditation of casinos will be valid for 30 years and may be renewed for successive periods.

The rapporteur also decided to take up, as a substitute, a suggestion considered by the Special Committee on National Development (CEDN) on the new contribution to be generated by the legalization of gambling in the country. As he explained, this tribute will be due to those who exploit "games of fortune" and will have a rate of 10% or 20%, depending on, respectively, the offer of the game in a physical or virtual environment.

The calculation basis should be the total gross revenue, after deducting the prizes paid. As for the proceeds from its collection, the Union must pass 30% to states and the Federal District and 30% to municipalities for compulsory application in health, welfare and social assistance.
