Winfil asks STF to suspend the processes of gambling in Brazil

Lawyers Laerte Luis Gschwenter and Maria Carolina Peres Soares Gschwenter, representatives of the Winfil gaming house in Porto Alegre, sent a request to Minister Luiz Fux to have the Extraordinary Appeal (RE 966177) urgently included in the panel of judges by the Plenary of the STF (the local Federal Court of Justice). In the document, they justify the need for urgency by citing conflicting decisions on the subject.

The letter was sent to STF Minister Luiz Fux, who is the rapporteur for the case that called for the inclusion in the agenda of the STF Plenary's judgment with urgency-priority of the action with acknowledgment of general repercussion in June / 2017, in addition to a request for the material to be taken over the entire national territory.

For Winfil's lawyers, the case must be included in the list of urgent judgments because: "Given the circumstances surrounding the case, especially the public and private interest, as well as practical issues that have led to conflicting decisions while not occurring the standardization," they say.

Also in the document they exemplify the judicial conflicts that have been happening citing the decisions of the 3rd Public Treasury Court of the District of Porto Alegre that closed the seizure / confiscation of equipment in Winfil and the Search and Seizure Mandate of the Special Criminal Court of the Forum of Tristeza Comarca of Porto Alegre / RS, which allowed the police operation that took place in the gaming venue in October.

The house was inaugurated on October 19, with machines operating without cash bets. Nine days later, Winfil started to allow the use of money in the slot machines. However, the house has been facing a series of problems with the Public Prosecutor's Office of Rio Grande do Sul, having so far faced two police operations that seized machines and disrupted the operation of the place.
