UK proposes changes to licence conditions for operators

The UK Gambling Commission is proposing changes to its licence conditions and codes of practice for operators relating to marketing and advertising. The UKGC stated that a plan to update its LCCP would make clearer “requirements that operators are fair and open with consumers.”

The proposals include also introducing a new requirement to prevent consumers from receiving spam marketing either by email or SMS; clarifying current requirements about misleading advertising; and making clear to licensees they are responsible for actions of third-party organisations they use.

In response to what it says is a declining public trust in gambling, the UKGC is planning to make clear that operators must obey all relevant customer protection legislation at all levels and not only when designing marketing materials.

Failure to meet the standards set out could result in heavy fines.

“If necessary, we will not hesitate to apply the full range of our regulatory powers, which includes financial penalties,” the UKGC’s proposals stated. Operators would also have a new eight-week time limit to resolve disputes.

The consultation process over the changes, which form part of the UKGC’s three-year consumer strategy, is open and continues up until April 22, 2018.
