Senate also approved the legalization of sports betting in Brazil

Just one day after the approval by the Chamber of Deputies, the Senate tonight also gave green light to the PM 846/18, which allocates money from lotteries to Public Security and legalizes sports betting in Brazil. Now it goes on for the presidential sanction that can happen this week or even tomorrow (Thursday). The proceedings in Congress took place in 24 hours.

The Senate Plenary approved on Wednesday evening (21) the provisional measure that allocates part of the funds collected with the sports and federal lotteries to the National Public Security Fund (FNSP). The proposal (MP 846/2018) also reformulates the financing of various sectors from the lottery funds, such as sports and culture.

The PM was edited in August as a new version of MP 841/2018, released in June and no longer valid. The new text emerged from a coordination of the Ministries of Culture and Sport, after pressures from entities from both sectors, since the previous PM decreased the lottery transfers to these areas to increase the resources of the National Public Security Fund (FNSP).

As the provisional measure had changes in its passage through the National Congress, the new text will now follow for presidential sanction.

According to the president of the Senate, Eunício Oliveira, the vote on the text was supported by the current Minister of Public Security, Raul Jungmann, and the future Minister of Justice, who will also be responsible for the area of security, Sérgio Moro.

Destinations

Of the funds raised from the sports lotteries, the PM will transfer to FNSP 1.49% this year and 2% from 2019. The fund will also receive 5% of the federal lottery funds in 2018 and 2.22% from next year. For the National Fund of Culture (FNC), the transfer will be 1% of the resources of sports lotteries. Of the resources of the federal lotteries, culture will also receive 0.5% from next year. FNC will still receive 0.4% of Lotex's funds.

The PM also states that the participation of the Ministry of Sports in the collection of sports lotteries will be 10% in 2018, falling to 3.1% from 2019. The quota of the Brazilian Olympic Committee (COB) is set at 1.63%, while the Brazilian Paralympic Committee (CPB) holds 0.96% of the resources of the sports lotteries. The PM allocates to the prizes of sports lotteries the value of 37.61% by the end of 2018 and 55% from next year.

The federal government expects that the PM of the Lotteries will guarantee the annual transfer of about R$ 1 billion (US$ 266m) for public safety, R$ 630 million (US$ 167m) for sports and R$ 443 million (US$ 115m) for culture.

Changes

The PM rapporteur was Senator Flexa Ribeiro (PSDB-PA). He said changes added to the text make the proposal even more advanced.

According to the formula approved by the Congress, the resources of the FNSP can not be contingent. The fund should allocate at least 50% of its reserve to the states and municipalities. In the case of the states, if there is a specific fund for the federation unit, the money can be sent directly, without going through Treasury.

Another highlight mentioned by Flexa was the guarantee that between 10% and 15% of the FNSP should finance housing programs and improve the quality of life for public safety professionals.

"There was never any such concern. They protect the lives of all of us," said the senator.

The PM also benefits two social entities: annually, the income from two competitions of the Sports Lottery must follow for the National Federation of Associations of Parents and Friends of the Exceptional (Fenapaes) and for the Red Cross. In the report, Flexa allocates the income of three contests per year to social entities, by including the National Federation of Associations Pestalozzi (Fenapestalozzi) as beneficiary.

Flexa also deals with the percentage distribution of the product of the prognostic lottery collection, benefiting areas such as public safety, health and the National Fund for the Rights of Children and Adolescents. Another change in the report was the determination that between 10% and 15% of the FNSP's lottery resources should be compulsorily applied in housing programs for the benefit of public safety professionals or in programs to improve the quality of life of these professionals.

Education

The rapporteur also proposes to establish a lottery modality called fixed quota bets - which may occur in physical or electronic ways. For the state, district and municipal education departments, Flexa suggests the transfer of 1% of the proceeds from the collection of fixed quota lotteries, when the bet is physical, and 0.75% when in a virtual environment. The amount will be passed on to schools that have achieved the targets set for the results of the national assessments of basic education, according to the Ministry of Education Act.

The report also establishes that the Court of Auditors of the Union (TCU), without prejudice to the analysis of the annual accounts of managers of public resources, should supervise the application of resources destined to the COB, CPB, Fenaclubes and other entities related to sport.

Vote against

Senator Randolfe Rodrigues (Rede-AP) declared a vote contrary to PM 846. The reason was a device that includes in the collection the sale of virtual tickets. Randolfe said he understood that this represented the regulation of online gambling. As he could not emphasize the specific passage, the senator said he preferred to reject the proposal in full.
