President Temer sanctions today PM that legalizes sports betting in Brazil

President Michel Temer will sanction PM 846/2018 this Wednesday at an event in the Noble Hall of the Planalto Palace at 3pm. The Provisional Measure that distributes the profits of the lotteries among culture, sport and security also legalized sports betting. The text was approved at the end of November by the House of Representatives and the Senate, after intense debate in a joint congressional committee. First key step towards opening the gaming market in the country.

The confirmation of the sanctioning ceremony was made on Tuesday (11) afternoon. The Minister of Sport, Leandro Cruz Fróes da Silva, issued an invitation announcing the ceremony that takes place today (Wednesday) at 3 pm in the Hall of the Planalto Palace.

The PM 846/2018 approval process began after the government overthrew of PM 841/2018, which drew resources from lotteries in areas such as culture and sport, to allocate them on security and was heavily criticized by cabinet ministers and by many sectors of opinion public. From then on, a joint committee formed by deputies and senators, presided over by Deputy Evandro Roman and the rapporteur of Senator Flexa Ribeiro, began to prepare the new text for analysis of the parliament.

It is worth remembering that PM 846 legalized fixed odd betting or sportsbook betting determining that 2.5% collection should be allocated to the National Public Security Fund (FNSP) when bets are carried out by physical ways and 1% if carried out online; which would mean onlendings millionaires to different areas coming from this new market that will open.

The PM determines a period of two years, extendable by two others, so that the Ministry of Finance establishes the rules for authorization of concession to the operators of the modality. The gaming market in electronic form on real sports events, where, on the occasion of the bet, the bettor knows the amount of the prize to be won if he hits the prognosis, is estimated at US$ 1.1 billion in Brazil.

At the suggestion of SEFEL, a proposal is presented that aims to make feasible the exploration of this new lottery modality, called fixed odd betting. Given that it is necessary to channel this lottery activity to the rules of Brazilian law, the prizes must be higher than traditional lotteries.

The PM also states that funds raised from the sports lotteries will be transferred to the FNSP by 1.49% this year and 2% from 2019. The fund will also receive 5% of the federal lottery funds in 2018 and 2.22% from next year. For the National Fund of Culture (FNC), the transfer will be 1% of the resources of sports lotteries. Of the resources of the federal lotteries, the culture area will also receive 0.5% from next year. FNC will still receive 0.4% of Lotex's funds.

In addition, the participation of the Ministry of Sports in the collection of sports lotteries will be 10% in 2018, falling to 3.1% from 2019. The quota of the Brazilian Olympic Committee (COB) is set at 1.63%, while the Brazilian Paralympic Committee (CPB) holds 0.96% of the resources of the sports lotteries. The PM allocates to the prizes of sports lotteries the value of 37.61% by the end of 2018 and 55% from next year.

The federal government expects that the PM of the Lotteries will guarantee the annual transfer of about US$ 255 million for public safety, US$ 161 million for sports and US$ 113 million for culture.

At the time of approval, the rapporteur of PM Senator Flexa Ribeiro (PSDB-PA) said that the changes added to the text make the proposal even more advanced.

According to the formula approved by the Congress, the resources of the FNSP can not be contingent. The fund should allocate at least 50% of its reserve to the states and municipalities. In the case of the states, if there is a specific fund for the federation unit, the money can be sent directly, without going through the Treasury.

Another topic highlighted by Flexa was the guarantee that between 10% and 15% of the FNSP should finance housing programs and improve the quality of life for public safety professionals.

The approval of PM 846/2018 with the legalization of sports betting represents a great victory in the gaming industry, which gives an important step towards the regulation of all types of games. Today there are two projects in Congress that would legalize the activity in Brazil; however, both are standing in the Senate and the House, awaiting analysis by the plenary of the two houses.
