LOTEX regulation decree was published and auction would be in June

Following the approval of the process by the TCU, the Official Gazette published the decree establishing the Brazilian Exclusive Instant Lottery - Lotex. In this way, the announcement must be published in the coming days and it is estimated that in June would be the auction that will define the winner of the concession. The result of the sales collection of the new lottery will be destinated 65% for prizes and 10% for the Ministry of Sports, to be applied in projects of school sports initiation.

Brazilian President Michel Temer and Finance Minister, Henrique Meirelles, issued Decree 9.327/2018, which regulates the Exclusive Instant Lottery (Lotex), created by law in 2015 and will be granted to the private sector as early as 2018. Government forecast is that the public bidding will come out in the next few days and the auction will take place in the second quarter of this year.

Regarding the edict, the Federal Audit Court (TCU) analyzed its terms and last month authorized the government to publish the document. Besides endorsing the bid, the TCU also recommended that the government draft a decree to regulate the service. The decree is published in the Official Gazette (DOU) today (Wednesday, 4).

Through the text, Lotex is officially established, implemented in a physical and virtual environment, in which bettors will immediately know the result of their bet without the need to wait for the draw or the lottery contest.

Lotex will have as its theme brands, emblems, hymns, symbols, shields and similar items related to professional sports organizations or other themes associated with events of great popular appeal, commemorative dates, cultural references, licensing of brands or characters and others graphic and visual elements that may increase the commercial attractiveness of the product.

The decree establishes that Lotex will be authorized by the Ministry of Finance and executed, throughout the national territory, by concession. In addition, the text defines that of the total collection of each issue will be allocated: 65% for the prizes; 10% for the Ministry of Sports, to be applied in sports initiation projects; 2.7% for sports organizations; 18.3% for expenses of operator costing and maintenance; 3% for the National Penitentiary Fund (Funpen); and 1% for Social Security.

The act also says that the Ministry of Finance is responsible "to authorize, homologate, standardize, and supervise the execution and operation of Lotex" and that "the operator shall provide the explanations and exhibit, for examination or expertise, the necessary elements for the exercise of oversight."
