The Notice 01/2018 that deals with the LOTEX concession was published in this Thursday edition of the Official Gazette of the Union and in the Valor Econômico newspaper. The text defines the procedures that the interested companies must do to participate in the competition and makes official that the auction will take place on June 14, 2018, at 10:00 am, at B3 - Brasil Bolsa Balcão's headquarters in São Paulo.
Bidders shall submit, on June 7, 2018, from 10:00 a.m. to 1:00 p.m., at B3 SA - Brasil Bolsa Balcão, located in São Paulo (SP), at Rua XV de Novembro, nº 275, Centro (three) sealed volumes, in two (2) ways each, containing: i) Volume 1 - Bid Security; ii) Volume 2 - Written Economic Proposal; and iii) Volume 3 - Qualification Documents.
The LOTEX privatization process began in 2016, and since then, the Ministry of Finance, through the extinct SEAE (Secretary for Economic Monitoring), the current Secretariat of Fiscal, Energy and Lottery Monitoring (SEFEL), has been working for the auction. Roadshow were held in major world gaming cities such as London and Las Vegas, as well as events in Rio de Janeiro and São Paulo, to explain the project to companies interested in exploring the new product.
The project also underwent an analysis of the TCU - Federal Court of Accounts, where it was approved. Only then, it could have the decree published this week by the Federal Government.
According to the decree, LOTEX will be authorized by the Ministry of Finance and executed, throughout the national territory, by concession. In addition, defines the text, of the total collection of each issue will be allocated: 65% for prizes; 10% for the Ministry of Sports, to be applied in sports initiation projects; 2.7% for sports organizations; 18.3% for expenses of operator costing and maintenance; 3% for the National Penitentiary Fund (Funpen); and 1% for Social Security.
The act also says that the Ministry of Finance is responsible "to authorize, homologate, standardize, and supervise the execution and operation of LOTEX" and that "the operator shall provide the explanations and exhibit, for examination or expertise, the necessary elements for the exercise of oversight".

EDITAL Nº 1/2018-PPI / PNDCONCESSÃO DO LOTEX
The National Bank for Economic and Social Development - BNDES, based on art. 2 of Decree 9.155, of September 11, 2017, hereby announces that it will carry out the bid for a common concession for the delegation of the operation of the public service of Exclusive Instant Lottery - LOTEX, in the form of Auction:
1) OBJECT: is the granting of the concession, aiming at the exploitation of the public service of Exclusive Instant Lottery - LOTEX under the terms and in the conditions established in the Notice and Annexes.
2) OBTAINING THE NOTICE AND ITS ANNEXES: The Bidding Documents and their Annexes may be obtained: i) in electronic media, at the BNDES headquarters, located in Rio de Janeiro (RJ), Avenida República do Chile, 100, CEP 20031-917 , on business days between April 5, 2018 and June 6, 2018, from 10:00 a.m. to 6:00 p.m., through a prior appointment with the Privatization Area, at the following electronic address: [email protected] .br; and / or ii) on the "LOTEX Privatization Information Room", on the Internet, with access available through the BNDES website (www.bndes.gov.br). in the Invitation.
3) CLARIFICATIONS ABOUT THE NOTICE: Interested parties who need further clarification may request them from BNDES by 6:00 PM on May 16, 2018. The requirements for requests for clarification are defined in the Notice.
4) ANSWER TO APPLICATIONS FOR CLARIFICATION: The Granting Commission will issue minutes of answers to the requests for clarification by May 30, 2018, making them available for access on the "LOTEX Privatization Information Room" on the Internet, with access available through the BNDES website (www.bndes.gov.br).
5) REQUIREMENTS FOR PARTICIPATION: the requirements for participation of interested parties, the conditions for submitting the documentation, the criteria for judging the proposals and the other conditions for the conclusion of the Concession Agreement are defined in the Invitation to Bid and its Annexes.
6) RECEIPT OF ENVELOPES: Bidders shall submit, on June 7, 2018, from 10:00 a.m. to 1:00 p.m., at B3 SA - Brasil Bolsa Balcão, located in São Paulo (SP), at Rua XV 3 (Three) sealed volumes, in two (2) ways each, containing: i) Volume 1 - Proposal Guarantee; ii) Volume 2 - Written Economic Proposal; and iii) Volume 3 - Qualification Documents.
7) ACHIEVEMENT OF THE AUCTION: The Auction, with the participation of the Proposers who have their Accepted Offer Guarantees, represented by Accredited Brokerages, will be held on June 14, 2018, at 10:00 am, at B3, located at Rua XV of November, 275, São Paulo / SP, according to the provisions in the Final Tender Protocol.
8) EXAMINATION OF QUALIFICATION DOCUMENTS: After the closing of the Auction, the Granting Commission will open and analyze the Qualification Documents only of the Bidder, which will rank first in the Auction, subject to the Bidding Rules.
