Brazilian lottery bettors may be required to report CPF

Caixa Economica Federal lottery participants may be required to register the CPF number (Portuguese for 'Natural Persons Register') at the time of each bet to facilitate the investigation of crimes such as money laundering and concealment of assets, rights and securities. PLS 412/2017 can already be included in the voting list of the Committee on Economic Affairs (CAE). The registration would apply to bets of Mega-Sena, Lotofácil, Lotomania, Double-Seine, Timemania, Quina, Loteca and Lotogol.

The rapporteur, Senator Pedro Chaves (PRB-MS), includes amendments to the bill submitted by Senator Paulo Bauer (PSDB-SC), which obliges lottery administrators to publish on the internet the name, CPF and address of the winners of prizes within 90 days. "There are numerous cases of suspicion and fraud. The objective is to improve the payment of prizes, giving greater transparency and honesty and avoiding suspicions about a series of 'coincidences' that occur in the draws," argues Paulo Bauer in justifying the project.

"The problem of lottery fraud is old," acknowledges Pedro Chaves, recalling the case of former deputy João Alves (BA), who resigned in 1994 because of involvement in the scandal known as "Dwarves of the Budget." At the time, Alves justified the growth of his equity claiming to have won 221 times in lotteries. "New scandals have arisen. In 2015, a gang specializing in fraudulent lottery payments diverted more than US$14.9 million in winning tickets, not drawn by the winners," says the rapporteur.

The senator, however, suggests changes to PLS 412/2017 for security reasons. "Brazil has had frightening rates of violence. There were almost 59,000 homicides in 2014 with only firearms. By disclosing the names of the people with their respective data, we will be creating a security problem for citizens who win lottery prizes," argues the rapporteur.

For Pedro Chaves, it is possible to raise the number of information available to the control bodies only with the registration of the CPF of the players at the moment of the bet. "The agents paying the prizes will be able to check if the number informed in each bet coincides with the number presented in the withdrawal of the respective prize," he argues.

According to the report, Caixa and lottery retailers must ensure the confidentiality of bettors' identification. In 30 days, the institution must contact the winners, who may receive the prize even if they have lost the ticket of the bet.

The registration of the CPF would be valid for the bets of Mega-Sena, Lotofácil, Lotomania, Douro-Sena, Timemania, Quina, Loteca and Lotogol. They would be outside the Federal Lottery and the Exclusive Instant Lottery (Lotex). "If all bets on lotteries had to fit the bill, ticket sellers on the streets would become unemployed," says Pedro Chaves.
