The Public Exclusive Instant Lottery (LOTEX) service will be granted to the private sector. The first stage of the granting of this concession was approved by the Federal Court of Audit (TCU).
The Court reviewed the first stage of this privatization, because the modeling of the concession changed after two occasions in which the dispute was considered deserted, without proposals from interested parties.
Items such as bid guarantee and contract performance amounts and prizes payment details have changed. In addition, there were adjustments to the calculation of indemnity amounts in the event of termination or cancellation and updating of contract values.
The concession is innovative because the monopoly over the operation of lotteries was previously exercised by Caixa Econômica Federal (Caixa) in the country.
The rapporteur of the process, Minister Aroldo Cedraz commented on "the risks arising from the fragility of a regulatory framework still under construction for a public service that does not exist today and that will be granted to private enterprise on a monopolistic basis." This is because the operation will be on an exclusive basis and will compete only with the other lottery modalities operated by Caixa.
The rapporteur-minister also mentioned that this is “an extremely important issue, as the Union cannot decide to extend the Instant Lottery concession model to other modalities of forecasting contests and, eventually, to other gambling that may be allowed in the country.”
