New bill enables sports entities to make deals on lottery resources in Brazil

Deputy Evandro Roman presented to the Chamber of Deputies a proposal that includes a new provision in Law No. 13,756, which, among other topics, deals with the destination of the collection of lotteries, so that the entities listed in art. 22, items I to VI may enter into agreements with each other to carry out actions, programs and projects provided for in the same legislation.

According to the proposal presented by the parliamentarian, art. 25-A to Law No. 13,756 of December 12, 2018, which reads as follows:

“Art. 25a. The entities listed in art. 22, items I to VI may enter into agreements with each other to carry out actions, programs and projects provided for in this Law.

§ 1°. The execution of the agreements dealt with in the caput of this article may be accompanied by transfer of the resources provided for in this Law.

§ 2°. The resources transferred in accordance with paragraph 1 of this article shall form the budget of the beneficiary entity, which shall be exclusively responsible for its regular execution, monitoring and accountability directly to the control and supervisory bodies.

§ 3°. The entity benefited with the transfer of resources provided for in Paragraph 1 shall be subject to all legal provisions provided for in this Law.”

Article 2. This law takes effect on the date of its publication.


In his justification, Deputy Roman states: “The bill presented here aims to open the possibility of bringing the private entities provided for in Law No. 13,756 / 2018 and the resources allocated to them closer to a more systemic model of interaction, so as to that an entity benefiting from resources may join another entity in order to meet the objectives set forth in the legislation itself.”

The parliamentarian also explained that “the intention is to open a window for entities to voluntarily collaborate with each other for the development and strengthening of national sport, including allowing resources to move more smoothly between entities, encouraging collaboration without generating operational and bureaucratic barriers.”

Concluding the justification, Evandro Romam states that his project does not foresee an increase in the transfer of lotteries to any sports entity, but will allow a truly systemic performance and the strengthening of sports policy.
