Brazilian deputy presents bill to authorize gambling at resorts and casino hotels

Deputy Eduardo Bismarck (PDT / CEA) presented this week, on October 1st, the Bill 5319/2019 that seeks to amend Decree Law No. 3,688 of 1941 (Criminal Offenses Act), to authorize the exploitation of gambling only in resorts of leisure and casino hotels authorized by the Federal Executive Branch. The bill now awaits Order of the President of the Chamber of Deputies.

The text presented by Congressman from Ceará state directly changes the art 50 of the current Law of Criminal Offenses that would come into force as follows:

“Art. 50. To establish or operate gambling in a public or publicly accessible place, with or without entrance fee, except at leisure resorts and casino hotels authorized by a regulatory body designated by the Federal Executive:

b) the hotel not authorized as casino hotels or leisure resorts by a regulatory agency designated by the Federal Executive, to which guests and residents are provided gambling;

(d) the establishment intended for the operation of gambling, even if such a destination is concealed, except as provided for in the head paragraph.” (NR).

In his justification, Eduardo Bismarck (PDT / CE) states that it is visible that the practice of gaming in Brazil is widely practiced, that the fact of being illegal does not prevent the activity to occur and make it regulated would be worthwhile and would bring benefits to society.

"The decriminalization of gambling in leisure resorts and casino hotels authorized by a regulatory agency designated by the Federal Executive Branch is meritorious, considering its beneficial effects on society. That is, removing the illegality of the activity, the Brazilians who adhere to this practice have emerged from the illegality, and may go to safe places destined for this purpose. On the other hand, the public budgets that suffer so much from the lack of resources have received important reinforcements", says the parliamentarian in his justification.

At the end of the text, Bismarck further argues that "at a time when social security reform is being discussed, decriminalization of gambling enables the creation of a specific contribution to social security, proving to be an important mechanism to promote social protection in Brazil."

The bill 5319/2019 presented by Eduardo Bismarck (PDT / CE) now joins other projects, such as 442/91 that deals with the Regulatory Framework of Gaming, and now await the order of the President of the Chamber of Deputies, Rodrigo Maia, to know how it would move forward. It may be voted in plenary or referred for discussion in other House committees.
