Amendment of club-company law could be key to the future of sports betting in Brazil

The Chamber of Deputies approved the urgency for the processing of the club-company project, proposed by Deputy Pedro Paulo (DEM-RJ) with the support of the President of the House, Rodrigo Maia (DEM-RJ). This bill should include the amendment that will deal with the changes of law 13.756 to make clear what is the basis of calculation for tax purposes and will deal with other indispensable provisions for the viability of the exploitation of sports betting in Brazil.

The urgency, which has received favorable votes from 329 parliamentarians, speeds up the passage of the bill, which will no longer have to go through committees before being taken to the plenary vote. Deputy Pedro Paulo's advisor foresees the vote of the club-company in the coming weeks, according to a statement sent to the press. The bill formulated by the deputy proposes a benefit package for clubs to leave the civil association structure and migrate to that of a company, as a limited company or corporation.

What is important to say is that in this Bill that is being dealt in the Chamber of Deputies, which was approved as a matter of urgency, it must include the amendment that will deal with the changes of law 13.756 with regard to sports betting. It is an amendment that will make clear what is the basis of calculation for tax purposes and will deal with other provisions that are indispensable for the viability of the exploitation of sports betting in Brazil.

Today, legislation dealing with fixed-odds sports betting is not enough to provide legal certainty and to make clear the tax incidence on the activity. Thus, this amendment that Congressman Pedro Paulo must introduce in this bill, whose urgency was approved on Tuesday, is fundamental for the future betting market in Brazil. And it is also a significant step so that after the approval of amendment of law 13.756, the Ministry of Finance can then regulate the modality and start authorizing this new activity in Brazil.

Benefits of the project include a new refinancing of club debt with the government, facilitating judicial recovery, declaring labor hyper-sufficiency for football players, and creating a simplified club-company tax, higher than what associations currently paying and less than conventional companies do.
