Brazilian deputy propose that resources from sports betting is not just for football

Representative Celio Silveira (PSDB / GO) presented a bill to amend item of art. 30 of Law 13,756, which 'provides for the FNSP, on the destination of proceeds from lottery collections and on commercial promotion and lottery modality denominated fixed-odds betting' to delete the expression 'of football modality' so that to allow to any other sports in Brazil to also receive funds derived from the transfer of their rights.

At the moment the article of the law contemplates:

"Art. 30. The proceeds from the collection of the fixed-odds betting shall be as follows:
I - in physical environment:

e) 2% (two percent) for sports organizations of FOOTBALL MODALITY that give up the rights to use their denominations, brands, emblems, hymns, symbols and the like for the dissemination and execution of the fixed-odds betting;

The deputy asks to change it so that it reads like this:

e) 2% (one percent) for sports entities that assign the rights to use their denominations, brands, emblems, hymns, symbols and the like for disclosure and execution of the fixed-odds betting;

In the justification of his proposal that currently awaits Dispatch of the President of the Chamber of Deputies, Silveira explains:

The goal of our proposal, when we suggest the suppression of the expression "football modality" as currently appears in the text of line "e" of subsection I of art. 30 of Law 13756/18, is to bring an equality treatment for all types of sports that are practiced in Brazil.

This was because during the course of the then Provisional Measure No. 846/2018 - which, after its appreciation and approval in the National Congress, had been converted into the current Law 13756/18 - there was an undesirable distortion of the original objectives of that MP, was restricted only to privileging the football modality.

However, in view of the reality that other sporting modalities practiced in the country are devoid of better and greater sources of resources, a context in which the collection of a new lottery would be an important and permanent source to foment the development and the growth of these other sporting modalities that are also so significant for national sport.

Therefore, in a context of absolute scarcity of state resources that can be used to promote the development of all other sports in the country, especially on the eve of another year of the Olympics, it seems excessive and unreasonable for current legislation to reserve, only for football, the amount equivalent to two percent of lottery bets, as a result of the assignment they may make of the rights to use their denominations, brands, emblems, hymns, symbols and the like for dissemination and execution of the fixed-odds betting.

Both the contradiction of the distribution of resources exclusively for football is that Law 13,756, of 2018 itself, is conflicting in defining fixed bets in article 29, paragraph 1, stating that the lottery modality "consists of betting system related to events in which it is defined, at the moment of placing the bet, how much the bettor can win in case of guessing the prognosis." It can be seen, therefore, that the norm deals with sports, which involves the most diverse modalities, not just football, as the law does in the following article, when dealing with the distribution of resources.

Still, it is worth mentioning that the collection of football clubs in relation to fixed-odds betting will also occur and will obviously be more substantial than other sports, since football is the most traditional sport in the country and will consequently generate more bets.

In this sense, we trust that this House will have the sensitivity to accompany and agree with our concerns espoused in this project in favor of national sport, since our legislative proposal is very necessary in order to better take advantage of the product of the collection of bets in fixed-odds betting, consolidating them as an important source of funds for the promotion of the most diverse sports modalities, even of lesser expression, but of immense importance for what they represent for the Brazilian Nation.
