Senate unleashed PL 186/2014 and gaming law can be voted on in Brazil’s Plenary

After receiving an opinion by the rejection in the Commission of Constitution, Justice and Citizenship (CCJ) in 2018, the bill of 186/2014 that governs the operation of games of chance throughout the national territory had been filed at the end of the Legislature (article 332 of the RISF). PL’s author, Senator Ciro Nogueira, was able to unleash the matter through the request 144/2019 and now awaits inclusion in the Agenda for discussion in a single shift, ready for deliberation of the Plenary.

The project of Senator Nogueira (PP-PI), re-elected for another eight years in the House, authorizes the exploration of "games of fortune", online or in person, throughout the national territory. The regulations, once approved and sanctioned by President Jair Bolsonaro, will contemplate the local popular jogo do bicho; video-bingo and video game; bingos; casinos in integrated leisure complexes; sports and non-sports betting and online casinos.

The accreditation for the operation of bingo and video bingo game will have a term of 20 years, renewable for an equal period, and will be the responsibility of the States. The casinos licenses will be valid for 30 years and may be renewed for successive periods.

In March 2018, the report of Senator Benedito de Lira (PP-AL), based on the 2014 project of Ciro Nogueira (PP-PI), was rejected by a majority of the commission (13 votes to 2). Even with the rejection in the CCJ, the bill will now proceed to the Senate floor, which may approve or reject the proposal definitively.

According to the rules of the Senate, it is the CCJ's opinion on the constitutionality of the matters. But the main Plenary is always sovereign over committees. If a project is rejected in the CCJ, it is possible for the senators to file an appeal to the Plenary.

After the rejection by the CCJ of the text of the reporter Benedito de Lira, there was a symbolic vote that resulted in the approval of another report, this time from the leader of the Rede no Senado (Senate Network), Randolfe Rodrigues (AP). His report advocated rejecting the text that legalized gaming activity under the argument that the bill, if approved, could encourage criminal practices such as money laundering, as well as increase cases of gambling addiction.

Senator Ciro Nogueira, the author of the original bill, said that financial resources for the monitoring of gambling and treatment of people with addiction would come from the collection of companies authorized to exploit the bets. "There are more slot machines in Brazil than in the United States, but here [in Brazil] the government has no financial return,” Nogueira protested.
