“The Ministry will put the regulation of sports betting on the street later this year”

The House of Representatives is discussing the regulation of online gaming in Brazil in order to protect consumers and raise revenue. Sputnik Brasil interviewed lawyer and professor Pedro Trengrouse to explain why and what are the advantages. He mentions that the norm should observe the 'integrity of sport, protection of the gambler, the consumer, the popular economy and measures against money laundering.'

Last May 22, the Sports Committee of the Chamber of Deputies held a public hearing at the request of Federal Deputy Evandro Roman (PSD-PR) in order to discuss the regulation of online gaming in Brazil which, according to the deputy, has already been made in more than 50 countries.

Businessmen from the sector, as well as representatives of national and international entities were present at the hearing. Law 13756/18, quoted by the lawyer, authorized sports betting gaming both by physical ways and also by the internet. The legislation was the fruit of Provisional Measure 13.756 / 18, of the then president Michel Temer (MDB).

Trengrouse adds that the measure must observe the "integrity of sport, protection of the gambler, the consumer, the popular economy and norms against money laundering."

Today, the Ministry of the Economy is mainly focused on the approval of the Pension Reform, pointed out as a crucial factor. However, the matter related to betting, according to Trengrouse, would already be quite advanced. "I believe that the Ministry later this year put the regulation of sports betting on the street," he said.

According to Pedro Trengrouse, there are several foreign experiences that can be used as examples for the establishment of such regulation. For example, Portugal made these regulations in 2015, and has already reviewed some points of the legislation.

"Brazil is able to look at all of these examples and evaluate what fits our reality ... Brazil is able to produce a very advanced legislation, just look at the side and put your head to think," he adds.

Trengrouse also notes that the regulation of technology-related issues runs counter to the fact that technological developments are faster than the ability to update legislative bodies. The lawyer also states that such regulation is necessary and not static, since it deals with rapidly advancing technologies.

The slowness of the regulatory process in Brazil is also highlighted by the lawyer, who believes that this is due to the succession of crises that the country faces in recent years.

"The explanation of Brazil has not advanced in these matters is that other issues ended up taking over the agenda, matters not so important from a structural point of view, much more conjuncture than structure. Now is the right time to move forward.”
