The 7 questions that make up SECAP's questionnaire on sports betting

The Public Electronic Hearing was officially launched yesterday, and today the Ministry of Economy publishes the submission form which includes a questionnaire with 7 questions related to the regulation of fixed odds sports betting. The participant may address only the topics of interest. Moreover, the Brazilian Government calls for an opinion on the operation, benchmark, inspection, controls, concession or permission and suggestions for adjustments of Law No. 13,756.

REGULATION OF FIXED ODDS BETTING

PRESENTATION
This public consultation aims to collect subsidies for the actions of the Ministry of Economy in the regulation of Fixed Odds Betting, pursuant to Chapter V, Law No. 13,756, of December 12, 2018.

Such regulation is underway, coordinated by the Secretariat of Evaluation, Planning, Energy and Lottery (Secap) of the Special Secretariat of Finance of the Ministry of Economy, and seeks to establish a regulatory model aligned with the best world practices, which provides a competitive environment for the lottery industry, in accordance with current legislation. It also seeks a regulatory model that addresses issues essential to the future operation of the public service, with the adoption of modern practices of safety, integrity, accountability, corporate social responsibility, fraud and money laundering prevention.

Thus, this Secretariat invites citizens to submit their contributions by completing a questionnaire, or their perceptions and additional suggestions related to the topic of this Consultation.

The Public Consultation Contributions Form includes a questionnaire with the following questions related to the regulation of fixed odds betting:

The participant may address only the topics of interest.

1) Considering the intrinsic characteristics of fixed odds betting, in physical and virtual ways, and the financial viability issues of the operation, is it understood as appropriate the distribution of the collection, provided for in article 30 of Law No. 13.756, of 12 December 2018? What would be the most appropriate form of legal provision for this distribution? Is there any global jurisdiction with this destination? Justify your answer.

2) What are the operating ways of fixed odds betting that can be shared with the regulator to provide robust oversight and control elements? Exemplify.

3) Which government agency or fixed odds betting regulation body can serve as a benchmark for the future operation in Brazil? Justify your answer.

4) What are the minimum market surveillance, control and monitoring processes? How can the market interact with the government? Are there any changes to criminal law or regulations that can help combat illegal gambling?

5) What would make the process more attractive: concession or permit? If concession, what would be the minimum number of companies? Justify your answer.

6) In your assessment, are there any points in Law No. 13,756, of December 12, 2018, which require adjustment, improvement or correction? What is the suggestion to change this legal instrument? Justify your answer.

7) Are there any points which you consider essential in the future regulation of fixed odds betting? What would be the ideal regulatory model, considering the national legal system? Comment and exemplify.
