Brazilian Justice: Media giant Globo did not illegally enriched with football draws in 2003

The Federal Regional Court of the 3rd Region exonerated Globo and filed a public civil action filed by the Federal Prosecutor, which accused the media giant of having billed with draws and gambling in 2003. The information was published by Observatório da Televisão. The promotion was “Jogada da Sorte” (Lucky Play), a magazine that talked about the Brazilian Championship and drawed prizes at popular TV show 'Domingão do Faustão'.

In a decision on Monday (26), federal judge Monica Nobre says that the viewer who wanted to compete in the “Jogada da Sorte” was told that he needed to answer winning questions, and that if he wanted to buy only the magazine and not participate in the draws, could do it.

“The coupon was bought on the purchase of ‘Jogada da Sorte’ magazine, and it was not possible to buy it alone without the magazine. If the consumer bought the magazine and did not want to participate in the promotion, it would be enough not to answer the question or to register their coupon in the lottery stores,” says the judge.

For Nobre, the fact that Globo made a lot of money with the “Jogada da Sorte” promotion is not illegal. "The fact that the promoter of the event made a very significant profit through the promotion does not mislead it and, furthermore, this fact is not prohibited by law," she concludes.

As a result, the lawsuit that lasted 12 years was definitively closed. The Public Prosecution Office filed a public civil action against Globo in 2007 asking for punishment against the practice of the “Jogada da Sorte” promotion, as it understood that the draws only happened to those who paid a fee of 3 reais. Globo claimed that participation was free.

The MPF also called for recognition of illicit enrichment in favor of Globo and Editora Globo, which published the magazine. The MPF argued that the practice caused damage to the companies competing with the defendants. It also requested that the companies be ordered to repay the amount improperly acquired.
