Brazilian Deputy Adjuto Afonso defends installation of state lottery in Amazonas

Deputy Adjuto Afonso (PDT) explained that games can be created and operated by States that have legislation, as long as these are in accordance with federal regulations. “Amazonas has had a law authorizing this activity since 2013. There are States that are already starting to set up their lotteries, and Amazonas must also do this, as it is an important source of income,” said Afonso.

The parliamentarian recalled that on October 30, the Supreme Federal Court (STF) plenary unanimously decided that the Federal Government it does not have a monopoly on lottery games in the country.

In this way, explained Afonso, the games can be created and exploited by the states that have legislation, as long as these are in accordance with federal regulations. And he raised the voice to request the installation of the state lottery in Amazonas, which was approved by law in 2013.

“Amazonas has had a law authorizing this activity since 2013”, he said, detailing that the law determines that 50% of the profits obtained from the exploitation of lottery games would be destined for social actions; and the other 50% would go to investment and sponsorship of sports and professional athletes from Amazonas.

"States like Minas Gerais and Mato Grosso are already starting to implement their lotteries, and Amazonas must also do this, as it is an important source of income," he said.

The Union's monopoly over lotteries was provided for in Decree-Law 204/1967 and was questioned in the Supreme Court in 2017 by the then governor of Rio de Janeiro, Luiz Fernando Pezão. Other states have also joined as interested in the action. The rule was also questioned by the Brazilian Association of State Lotteries (ABLE).
