Debaters call for 'simple legislation'

Experts defend recognition of eSports as a traditional sport in Brazil

In 2019, the gaming sector had revenues of US$120 billion worldwide, a 3% up over the previous year. This industry employs thousands of people, among which are electronic game athletes. To discuss labor regulations for professionals, Parliamentary Front of the Electronic Games of Brazil’s Chamber of Deputies recently held a virtual meeting with representatives of the area. Currently, eSports leagues and federations comply with the general sports regulations, known as the ‘Pelé Law’.

The legal director of the Rio de Janeiro State Federation of Electronic Sports, Paulo Volpini, recalled that some electronic sports teams already work under the provisions of the ‘Pelé Law’, which for him has been sufficient to guarantee the labor relations of the professionals of the sector.

Professionalization

Lawyer Daniel Falcão, on the other hand, warns of the need to recognize electronic games as a sport to ensure that this modality follows the current legislation and its athletes can become professional.

"We are on our way, we are actually already in a professionalization in which there are sports entities, sports leagues, eventually sports clubs and athletes participating in this new economic and entertainment market as well," he said.

The representative of the National Sports Law Association, Ricardo Affonso, stated that the legislation for electronic sports has to be simple, so as not to jeopardize the labor relations of these athletes.

“There would be no need as is the case with other sports with numerous regulations. What we would need is effective recognition as a sport. Then the laws already in force in the country would be applied, which would be the general law of sport, and subsidiarily the CLT or the civil law for those who are not employed, who would be self-employed athletes. And in that case, they would not dispute the collective modalities because of the general sports law,” he observed.

Education

The president of the Parliamentary Front of Electronic Games, deputy Colonel Chrisóstomo (PSL-RO), highlighted the ability to mobilize electronic games events.

“An open game event brings together 30, 40, 50 thousand people. Of course, at that moment, we cannot do that, but the big businessmen in the area, the big influencers are dying to pass this moment because now the world has become complicated,” he said.

For Colonel Chrisóstomo, electronic games, when well used, are important tools for the education of young people and children.
