Brazilian lottery retailers await Caixa response, remain open even after court decision

A Federal Court decision that suspended a presidential decree article that considered lottery stores as essential services created legal uncertainty for the owners in Campo Grande, who are now awaiting guidance from Caixa on the matter. At first, the places will continue to operate according to the rules established by the city hall, said Sinal-MS (Union of Lottery Agents of the State of Mato Grosso do Sul).

With the doors closed since March 16th due to the decree N° 14,200, the businessmen of the branch had on Thursday (27) authorization from the management to reopen from Friday (28), same day of the decision that, contrary to President Jair Bolsonaro, judged the service as not essential.

“We still don't have a clear understanding of the scope of the Rio de Janeiro judge's decision. Caixa's legal counsel will comment on the matter. The municipal and state decrees that order to open (in the case of Campo Grande with rules) or close are valid due to the decision of Minister Marco Aurélio of the STF [Supreme Federal Court]”, explained the president of the entity, Ricardo Amado Costa.

He recalled that, even supported to reopen, businessmen will be able to decide if they will do it or maintain isolation, assessing the risks and scenarios of each of the companies. Under the contract signed with Caixa, they are entitled to up to 90 days of license.

New rules

After Bolsonaro included the lotteries in the list of essential services, the city of Campo Grande had to release the operation of the establishments. However, Mayor Marquinhos Trad (PSD) went so far as to say that, due to the management, they would remain closed during the quarantine, but they could not contradict the Union. Therefore, the management was responsible for regulating the rules for reopening.

By the new regulation, it was defined as opening hours from 9 am to 5 pm; reopening with complete cleaning of the place and, after every two hours, a new cleaning; and maximum capacity that allows a distance of 1.5 meters from one to the other, including cashiers. It was also determined by the municipal administration that all employees must wear masks and gloves and all places must have alcohol gel, otherwise they will not be able to reopen.

For the sector, the situation creates an impasse. "There is enormous legal confusion and insecurity for all of us lottery entrepreneurs," said the union president, who added that he is waiting for a statement from Caixa on the matter as soon as possible.
