Spain tightens restrictions on online gambling advertising during COVID-19 crisis

The Spanish Council of Ministers approved a package of measures focused on reducing the advertising of online gambling during the coronavirus pandemic. Companies may not offer bonuses and gifts to attract or retain customers. Betting may not be incited by referring to the exceptional situation resulting from the COVID-19 disease, while advertisements are prohibited except in the time slot from 1:00 to 5:00 in the morning, both on radio, TV and the Internet.

The Government of Spain considers that, given the situation of confinement, it can generate health risks in the population and aggravate the problems related to gambling in those that already suffered with the activity.

Through this new Within the Royal Decree-Law, by which urgent complementary measures are taken in the social and economic field to deal with COVID-19, the Government prohibits all online gambling announcements that refer to the exceptional situation that derives from the disease COVID-19 or invites to play in relation to this situation.

In the same way, online gambling and betting advertising is prohibited except in the time slot from 1:00 to 5:00 in the morning, both on radio, television and on digital platforms. Likewise, individualized communications through email and social networks are not allowed.

Finally, the Government prohibits gambling operators from using bonuses, discounts or gifts that collect economic amounts to attract new customers or to retain existing ones.

This package seeks to protect public health, because home confinement conditions favor the appearance and development of new cases of gambling addiction.

In the same way, the Executive understands that exposure to online gaming advertising exacerbates existing disorder problems, interferes with the treatment of people who are in the process of recovery and can cause relapses in those who were already recovered.
