Brazil’s MPF wants to ban betting activities in lottery retailers during pandemic

The Federal Public Ministry (MPF) of Brazil filed on Wednesday (1st) an appeal against the decision of the Federal Regional Court of the 2nd Region (TRF2) that allows religious institutions and lottery stores to function during the COVID-19 crisis. MPF advocates opening lottery retailers only for banking services and not for betting. The judicial discussion started after President Bolsonaro's decree that determined different services as essential during the pandemic.

In the appeal against the presidency decision of the Federal Regional Court of the 2nd Region (TRF2), the MPF asks for judicial authorization only for the operation of lottery houses that are banking branches of Caixa Econômica Federal. The MPF wants the ban on gambling and betting transactions, respecting the minimum distance between people by the rules of the Ministry of Health.

In the previous decision, the presidency of TRF2 understood that lotteries and religious activities are essential services, as stated by federal decree. In addition, it stressed that it is not for the Judiciary to interfere in exclusive attributions of the Legislative and the Executive.

In its text, judge Roy Reis Friede says that "the moment of world pandemic and public calamity cannot be used to allow the perpetration of affront to the Constitution of the Republic and the consecrated Separation of Powers Principle."

The MPF, in turn, pointed out “total illegality in defining the activities of religious services in temples and the opening of 'lottery channels' for all purposes as essential.”
