Brazil’s Economy Minister signs decree and forwards sports betting for privatization

In a resolution published this Friday (19) in the Official Gazette (DOU), the Minister of Economy Paulo Guedes qualified the public lottery service called 'Fixed-Quota Bets' (sports betting) in the Investment Partnership Program (PPI) of the Presidency of the Republic, allowing its inclusion in the National Privatization Program (PND). The process is monitored by the National Bank for Economic and Social Development (BNDES) and supervised by the Ministry of Economy.

In addition to the minister, the resolution is also signed by Martha Seiller, PPI's special secretary. The act is dated June 10, 2020, but was only published this Friday (19).

By Law No. 13,756 / 2018, the mentioned lottery "consists of a betting system related to real sports-themed events, in which it is defined, at the moment of placing the bet, how much the bettor can win in case of a correct prognosis."

The text of the resolution states that the qualification of the lottery modality for privatization considers "the need to reorder the strategic position of the State in the economy, transferring activities unduly exploited by the public sector to the private sector."

Currently, the "Fixed-Quota Betting" service is administered exclusively by the Union. If president Bolsonaro decides to qualify for the PPI and the PND, a period will be opened for studies on the possibilities of privatization. The process is monitored by the National Bank for Economic and Social Development (BNDES).

According to Law No. 13,756 / 2018, the proceeds from the collection of the sports lottery are destined as follows: in physical environment (80% for payment of prizes; 0.5% for social security; 1% for educational entities; 2.5 % for FNSP; 2% for football sports entities; and 14% for expenses and maintenance coverage).

In a virtual environment, is it as follows: 89% for prize payments; 0.25% for social security; 0.75% for educational entities; 1% for FNSP; 1% for football sports entities; and 8% expenses and maintenance.

RESOLUTION No. 134, OF JUNE 10, 2020

It opines for the qualification of the privatization of the public lottery service called Fixed-Quota Betting in the Investment Partnership Program of the Presidency of the Republic (PPI) and for its inclusion in the National Privatization Program (PND).

THE INVESTMENT PARTNERSHIP PROGRAM COUNCIL, using the powers conferred on it by art. 7, caput, items I and V, item "c", of Law No. 13,334, of September 13, 2016, and

Considering the need to reorder the State's strategic position in the economy, transferring activities unduly exploited by the public sector to the private sector;

Considering the need to allow the Federal Public Administration to concentrate its efforts on activities in which the presence of the State is essential for the achievement of national priorities;

Considering the need to expand investment and employment opportunities in the country and to stimulate national economic development, especially through actions focused on expanding and improving the services provided to the Brazilian population;

Considering that the lottery modality called Fixed-Quota Betting is an exclusive public service of the Union, whose commercial exploitation will occur throughout the national territory, according to art. 29 of Law No. 13,756, of December 12, 2018, resolves:

Art. 1º To give a favorable opinion and submit to the deliberation of the President of the Republic the qualification of the public lottery service called Fixed-Quota Betting, instituted by Law No. 13,756, of December 12, 2018, in the Investment Partnership Program of the Presidency of the Republic (PPI) and its inclusion in the National Privatization Program (PND).

Art. 2° Recommend the designation of the National Bank for Economic and Social Development - BNDES as responsible for the execution and monitoring of the privatization process referred to in art. 1, under the terms of § 1 of art. 6th and art. 18 of Law No. 9,491, of September 9, 1997.

Sole paragraph: The Ministry of Economy is responsible for coordinating and monitoring the privatization referred to in the caput of art. 2nd, as well as approval of studies, projects, surveys or investigations, necessary for the effectiveness of said privatization.

Art. 3° This Resolution enters into force on the date of its publication.
