Deputies Chamber approves PM basic text authorizing draws on Brazil’s radio and TV

The plenary session of the Brazilian Chamber of Deputies approved, in a virtual session yesterday (Wednesday 3), the basic text of Provisional Measure (PM) 923/20, which authorizes draws with prizes by television and radio broadcasters across the country or by civil society organizations. Parliamentarians still need to analyze the highlights that may alter points in the text.

The session had several attempts to avoid voting on the measure. The PSB and PODEMOS benches filed requests asking for the withdrawal of the proposal from the agenda, however, both were rejected. In a second move to delay the vote, PODEMOS asked that it be done article by article, a move that was also overturned by parliamentarians.

The rapporteur presented the general rules of the project and said that games of chance and bingo are prohibited. He restricted participation in the draws to those over 18. Prior registration of the participant will be required, either electronically or by telephone, and confirmation of the Individual Taxpayer Registration (CPF).

The Ministry of Economy must regulate these draws. The base text, however, states that the free distribution of prizes equivalent to R$ 10,000 (US$ 1,945) per month will be exempt from authorization. This amount will be adjusted annually for inflation (INPC).

 

 

Deputy Fernando Monteiro recalled that the PM was presented before the COVID-19 pandemic, and that some companies have already started to adopt the draws. "We are in a time of crisis, we need to provide subsidies for radios and TVs to survive."

The substitute presented by the rapporteur extended to national and regional open radio and television networks the possibility of carrying out free distribution of prizes for advertising purposes, carried out by drawing, gift certificate, contest or similar operation.

Amendment 47 of the President of the Parliamentary Front for the Approval of the Regulatory Framework, Deputy Bacelar, which called for the repeal of articles 50 to 58 of Decree-Law No. 3,688 of October 3, 1941 to decriminalize gambling, was rejected by deputy Fernando Monteiro.

The Plenary amendment by deputy Paulinho da Força (SD-SP) was also withdrawn, which defended and proposed changes in Law 13.756 / 18 that legalized sports betting as a fixed-rate lottery modality.

 

 

During the debate on the matter, the parliamentarians who were against the proposals criticized the lack of relevance of the measure at a time when the pandemic should be the priority of the House, that it would allow gaming to enter people's homes, transforming them into real casinos and that it would bring benefits only to TV networks that support the president of the republic.

Those who defended the project argued that the measure benefited small radios and broadcasters all over the country, which would not bring costs to the population since it was a non-costly participation and would give a new possibility of income to those who were drawn with the prizes.

In the end, the merit of the question of the provisional measure was voted and approved by the parliamentarians who started to debate the highlights having rejected the amendments proposed by PSOL and ending the session that will continue today (4) with the analysis of the other highlights.
