Bolsonaro signed the decree that includes sports betting on Brazil's PPI

The government took a fundamental step this Wednesday (19) in the process of regulating sports betting in Brazil with a decree signed by President Jair Bolsonaro by which he informs his agreement with the inclusion of the service in the Partnership and Investment Program (PPI). Through the decree, the government initiates the process so that the business of fixed-odd betting can be offered by the private sector. The BNDES will be responsible for execution and the Ministry of Economy will be in charge of coordination and monitoring.

The Decree expresses the Chief Executive's agreement with the decision of the Board of the Investment Partnerships Program (PPI), which, in its Resolution nº 134/2020, qualified the public lottery service called “fixed-odds betting” in that Program, as well as included the service in the National Privatization Plan (PND).

“Law No. 13,756, of December 12, 2018, instituted in the country the lottery modality called ‘Fixed-Odds Betting’, commonly known as ‘sports betting’, in which the bettor tries to predict the outcome of real sporting events and determined that bets are placed in a competitive environment, with the possibility of delegating the service to the private sector,” informed Planalto.

In this way, the qualification of “Fixed-Odds Betting” in the PPI and its inclusion in the PND aim at the privatization of the service so that the modeling and study of the service by the private market is made possible, under regulation and inspection by the Ministry of Economy, bringing returns to the State and providing employment and income generation in Brazil. PPI is the responsibility of the Ministry of Economy.

The decree specifies that the National Bank for Economic Development and Social (BNDES) will be responsible for executing and monitoring the privatization process and the Ministry of Economy is responsible for coordinating and monitoring the privatization referred to in the caput, as well as for the approval of the studies, projects, surveys or investigations necessary to carry out the referred privatization.

The decree is a major step forward for the regulation of sports betting in fixed-odds. We are working very transparently so that the sector is regulated soon. It is not a simple task, we will have a sector regulated with the best worldwide practices, with corporate social responsibility, safety for consumers and operators and integrity for the sport,” comments to Games Magazine Brasil, Waldir Marques Jr., Undersecretary of Prizes and Draws of Brazil’s Ministry of Economy.

 

 

The measure authorized by the decree aims to privatize the service in such a way that the modeling is studied and the exploitation of the service by the private market is made possible, under regulation and inspection by the Ministry of Economy, bringing financial returns to the government.

Full text of Decree Nº 10.467:

Provides for the qualification of the public lottery service called fixed-odds betting instituted by Law No. 13,756, of December 12, 2018, within the scope of the Investment Partnership Program of the Presidency of the Republic and its inclusion in the National Privatization Program.

THE PRESIDENT OF THE REPUBLIC, using the powers conferred on him by art. 84, caput, items IV and VI, item "a", of the Constitution, and in view of the provisions of art. 4 of Law No. 13,334, of September 13, 2016, and Resolution No. 134, of June 10, 2020, of the Council for the Investment Partnership Program of the Presidency of the Republic,

DECREES:

Art. 1 The public lottery service called fixed-odds betting instituted by Law no. 13,756, of December 12, 2018 is qualified within the scope of the Investment Partnership Program of the Presidency of the Republic (PPI), and included in the National Privatization Program (PND).

Art. 2 The National Bank for Economic and Social Development is designated as responsible for executing and monitoring the privatization process referred to in art. 1, under the terms of § 1 of art. 6th and art. 18 of Law No. 9,491, of September 9, 1997.

Single paragraph. The Ministry of Economy is responsible for coordinating and monitoring the privatization dealt with in the caput, as well as for approving the studies, projects, surveys or investigations necessary for the effectiveness of the referred privatization.

Art. 3 This Decree comes into force on the date of its publication.
