Delay in regulating betting leaves Brazil without taxing a US$2 billion market

In a live held yesterday on Instagram, Rafael Plastina, CEO of Sport Track, and Luciano Pinheiro, partner at Corrêa da Veiga Advogados, discussed the topic “Sports Betting”, associating the arrival of large companies in the sector to Brazil’s need to find sources of revenue against to face its economic crisis. “It is estimated a market of more than US$ 2 billion in Brazil. The delay in regulation means that this entire volume of resources is not taxed. More people are betting and the government receives nothing,” said Plastina.

According to Plastina, Brazil needs to raise more, especially in a sector where the collection is being avoided, “because the Brazilian bet on international sites and there is no taxation at all. It is very important that the government quickly regulates the activity.”

We are 'invaded' by many bookmakers and we see this, for example, in the Brasileirão, where three companies in the sector have strong presence in the stadiums. Bodog, Betfair and Betcris are seen in all Serie A matches in the championship. In addition, several other companies in the sector are associated with teams, both from Series A and Series B, which demonstrates the interest that Brazil arouses,” adds Plastina.

Pinheiro says that the beginning of discussions on the regulation of sports betting began when online poker appeared. “Since that time, I have participated in forums on the topic and how to make the activity legal. Only in 2018 a law was reached for the segment, still pending regulation,”  he states.

It is in the government's interest that regulation happens as soon as possible to start collecting money,” he analyzes, saying that without regulation all sports betting is irregular, but it is no longer a criminal offense, since the government authorized the operation of the activity through a concession.

Plastina also commented that “we are reaching the two years initially planned for the regulation of sports betting and Brazilians are betting more and more, without the government collecting taxes.”

Pinheiro also questioned when the regulation will happen. “The BNDES should be quick in the process of finalizing the regulation based on the recent inclusion of the activity in a PPI. You can't reinvent the wheel. There are adequate regulations and they have been widely discussed. The only problem to be solved is in relation to the tax burden and the form of impact, on the turnover or on the GGR. If the government decides to tax on the betting turn, we will not have any sports betting company operating in Brazil. The ideal way is on GGR, in which it is verified what was the profit of the bookmaker and then collect the tax,” he analyzed.
