Argentine province of Mendoza seeks to regulate online gambling

The Province seeks to regulate online gambling to frame it in the laws that govern gambling in physical venues and that pay taxes in Mendoza. Ida López, head of the Provincial Institute of Gaming and Casinos, confirmed that the activity “already exists and there is a legal vacuum with extreme consequences of vulnerability for people. The project seeks to control the enabled platforms and thus establish the responsible gaming program.'

According to the information, with the rules to be established, a bettor could self-limit in the amount of time or money he bets.

The discussion about the regulation of online gambling has been going on for some time. However, due to the pandemic, this has increased, and the authorities considered the urgency of its regulation.

This activity includes all games of chance, raffles, draws, bets, random combinations and in general all those activities in which amounts of money or objects are at stake, economically assessable on the results and that allow their transfer between the participants.

This is independent of whether they have public or private origin, as established by provincial law No. 6,362, and provided that it is carried out through electronic means.

On the other hand, the law determines the creation of two registries. On the one hand, a Register of Online Gaming Qualifying Titles will be created, which will be public and accessible, dependent on the Provincial Institute of Gaming and Casinos. The Registry must contain information on the human or legal persons that have a license granted by the enforcement authority to develop and organize online gambling activity.

On the other hand, a regulated Online Gaming Players Register will be implemented. Said registry must contain the following information about all the players who participate in the online gaming activity: name and surname, type and number of identity document, age, address and any other information established in the regulations.
