Currently, the free distribution of prizes, by lot, as advertising, is regulated by Law 5.768 / 71. For Dr. Jaziel, given the new technological scenario, the need to update the legislation is indisputable.
"We aim to meet the desires of self-employed professionals who seek free distribution of prizes for advertising purposes, mainly through social networks, but who, as individuals and not legal entities, face a legislative vacuum," explains the parliamentarian.
The deputy also stresses the importance of including religious institutions among the entities that can distribute prizes by drawing lots, including digitally, to obtain the necessary resources for their maintenance or the cost of social work to which they dedicate themselves.
According to Dr. Jaziel, in general, these sweepstakes distribute prizes of low value. "Thus, in order to reduce the bureaucracy in the system and avoid overloading the competent bodies, we understand that it is necessary to dispense with the requirement of prior authorization for operations involving premiums of up to R$ 10,000."
The Ministry of Economy must regulate the drawing of draws in order to guarantee the safety, transparency and publicity of the results. In addition, the distribution of cash prizes, the playing of games of chance or bingo and the participation of minors under 18 in the draws are prohibited.
Processing
The project will be analyzed, conclusively, by the Finance and Taxation commissions; and Constitution and Justice and Citizenship.
