Betting regulation in Brazil will be key and necessary for eradication of fraud

A study published by lawyer Cássia Rafaelle Amorim Travassos, a bachelor from Universidade Estácio do Pará and a researcher in the field of sports law, deals with the imminent regulation of sports betting and the positive points of this legalization. In the work “The Regulation of Lotteries in Brazil and Aspects of Corporate Social Responsibility in Lotteries”, the author talks about the good practices of the sector, compliance, combating the manipulation of results and inspection of the activity.

Researcher on sports law, Cássia Rafaelle justifies the elaboration of her study highlighting “the imminent regulation of Sports Lotteries in Brazil, analyzing the positive points of this legalization.”

For Rafaelle, the manipulation of results is a problem to be faced in the regulatory process, “since the numbers increase more and more in cases of fraud in sports betting.” For this reason, the author defends Compliance, “a program that can be used as a way to prevent fraud in bets, manipulation of results and corruption in the sports environment, as well as pointing out some examples of global institutions that have already loved this program as a way of risk prevention.”

In the presentation summary of the theme, Cássia Rafaelle explains that “the purpose of this paper is to clarify the need for inspection, monitoring and prevention programs to curb fraudulent practices in sports lotteries in Brazil.”

FINAL CONSIDERATIONS

In the present work, Law 13.756 / 18, the law that regulates Sports Lotteries in Brazil, was presented. It was discussed about its positive and negative points, as well as the expectations in the scope of sports betting regarding its entry into force.

It was portrayed the online sports betting modality and how its legalization can contribute to revenue collection and the economy in general. This is because, even though it is not a legalized market, the sites with hosting abroad offer gaming options to Brazilians without any regulation and control.

It clarified what result manipulation is and how this problem can be tackled in the regulatory process. Exemplified the manipulation of results and fraud in sports betting through global and national cases involving Tennis and Football, where these two sports are the main targets of corruption. Tennis for being an individual sport and for the high values ​​raised in betting, as around 200 billion euros are bet in a tennis season.

Football is also one of the main targets because according to research carried out by the Federal University of Rio Grande do Sul (UFRS), between 70% and 85% of the amount invested in betting is in this modality. For this reason, the volume of bets on football games in Brazil has multiplied, the values move about R$ 100 million in games of series A.

Thus, the entry into force of Law 13.756 / 18 will contribute significantly to the eradication of fraud in sports betting, in addition to protecting bettors regarding the consumption relationship.

Does sports betting regulation, by itself, eradicate the problem of result manipulation? This question was answered in the course of this monograph, in order to indicate examples of countries where this type of betting is legalized.

The regulation will not definitively end the problem of betting fraud, but it will significantly reduce the numbers, since the legalization of the market will help to improve communication between bookmakers, federations, leagues and the police. In addition, it is necessary to create means of inspection capable of monitoring, preventing, and restraining such fraudulent practices. As a result, it is important for the government to hire a specialized team for these activities, in addition to investing in technology.

However, this work presented Compliance, and showed that the application of this program can be used to combat and prevent the manipulation of results. It also indicated that some global institutions have also adopted this program, stressing the importance of the country being based on countries that have been successful in this area.

Therefore, models of an international and independent agency dedicated to fighting corruption in sport were mentioned, such as the World Anti-Doping Agency, a compliance company that monitors, prevents, and educates. I Trust Sport, a sports governance and compliance agency that is dedicated to improving the international governance of sport through collaboration. Finally, the Tennis Integrity Unit (TIU), an anti-corruption body that covers all tennis professionals in the world; is responsible for applying the sport's zero-tolerance policy in relation to gambling-related corruption.

The need to use technology as a way to monitor and ensure integrity in sport and the future of the sports betting market was analyzed.

Therefore, it is concluded that, according to the examples cited in the world, it is necessary to create a compliance agency, an independent anti-corruption body, in order to combat the manipulation of results in sports betting. It is not enough just to have a regulation; it is essential to create fraud detection and prevention mechanisms. Therefore, in this program, there is monitoring in sport, to check suspicious betting patterns. However, prevention will be a strategy to abolish this problem in Brazil.
