Senator must present a substitute for legalization

STF postponed RE 966.177 judgment, now gaming lobbyists in Brazil wait for Angelo Coronel

The postponement of judgment in the Supreme Court (STF) caused the lobbyists working for the legalization of casinos in Brazil to turn their full attention to Senator Angelo Coronel. The Bahian parliamentarian will present a more comprehensive substitute than Senator Roberto Rocha's project that links casinos to new resort developments. The appeal with general repercussion will only be judged in the STF when the pandemic is more controlled.

Ministers will decide whether the 1941 Criminal Misdemeanor Law is in line with the Constitution and, therefore, whether the exploitation of gambling is illegal.

This case was on the agenda for this week's trials but finally postponed without a definite date. Most likely, it will be included in the agenda on the second semester.

In the meetings that gaming lobbyists had last year with the rapporteur of the case in the STF, the minister Luiz Fux, they felt that he did not want the judgment in the full crisis of the pandemic.

“The government will have access to a new source of resources, through the taxation of the sector, which can be used to finance social policies. I estimate that the collection of taxes could reach R$ 60 billion, generating 700 thousand direct jobs. The STF will be able to open this new window of opportunities for Brazil,” defends the senator.

Angelo Coronel is rapporteur for Bill 2,648 / 2019, which allows the opening of casinos in resorts, a topic also dealt with in Bill 4,495 / 2020, by Senator Irajá (PSD-TO). Other projects in the Senate also deal with the liberation and regulation of gambling activities.

The most comprehensive is Bill 186/2014, by Ciro Nogueira (PP-PI), which simultaneously regulates jogo do bicho, bingo, electronic games, video lottery, video bingo, resort casinos, online sports betting, and online bingo games.

Bill 595/2015 is also pending in the Senate, which allows the opening of casino hotels in conservation units.
