Changes to art. 2nd of Decree nº 47.902

Governor Romeu Zema Neto adds sports betting to regulation of Loteria Mineira

By means of a decree signed on April 30 and already published in the Official Gazette-MG, Governor Romeu Zema changed art. 2 of Decree nº 47.902, of March 31, 2020, which contains the regulation of the Lottery of the State of Minas Gerais. Following the resolution of the STF that ended Caixa monopoly, Zema included in the text that now LEMG can explore all the lottery modalities provided for in federal legislation through online and physical channels, and added sports betting (fixed-quota).

This change in regulation via ordinance was necessary since last month Loteria Mineira issued a notice of opening of the Expression of Interest Procedure (PMI) which aims to obtain feasibility studies, surveys, investigations, data, technical information, projects or opinions for structuring the concession model for the purpose of executing the public service of exploitation of the Conventional Lottery (Passive) and the Lottery of Numbers, Individual and Immediate Draw (Loteria Instantânea), both in physical medium.

Intralot, Thorsborg and the IGT / Scientific Games consortium were considered fit as requested in this PMI opened in March. The preparation and presentation of studies, projects or opinions must comply with the terms of item 7 of the Notice: To be delivered within 45 (forty-five) days from the publication of the authorization, which can be extended, at LEMG's discretion, upon justification.

Following, Decree No. 48,184 signed by el Gobernador Romeu Zema:

Amends art. 2 of Decree nº 47.902, of March 31, 2020, which contains the regulation of the Lottery of the State of Minas Gerais.

THE GOVERNOR OF THE STATE OF MINAS GERAIS, using the powers conferred on him by item VII of art. 90 of the State Constitution and in view of the provisions of Law No. 22,257, of July 27, 2016, and Law No. 23,304, of May 30, 2019,

DECREES:

Art. 1 - The caput and § 2 of art. 2 of Decree 47.902, of March 31, 2020, come into force with the following wording, with the article being added to § 4:

Art. 2 - Lemg has the competence to generate resources and allocate them to the promotion of social well-being and programs in the areas of assistance, sport, education, health and social development, through the exploitation of lottery games and the like in the State, including electronic games through physical and digital media, in compliance with the lottery modalities provided for in federal legislation, with the following duties:

§ 2 - A lottery game is considered to be any operation, game or bet in the form of a prognostic contest, for obtaining a cash prize or in goods of another nature, regardless of the denomination and the betting extraction and capture process adopted, including the electronic game through physical and digital media, Online and Online-Real Time.

§ 4 - Lottery modalities are considered:

I - federal lottery (passive type): lottery in which the bettor acquires a numbered ticket, in physical (printed) or virtual (electronic) medium;

II - lottery of numerical predictions: lottery in which the bettor tries to predict which numbers will be drawn in the contest;

III - lottery of sports predictions: lottery in which the bettor tries to predict the outcome of sporting events;

IV - instant lottery: lottery that shows, immediately, whether or not the player was awarded a prize;

V - fixed-odds betting lottery: lottery of forecasts that consists of a betting system related to real sports-themed events, in which it is defined, at the moment of placing the bet, how much the bettor can win in case of a correct prediction.”
