Bolsonaro vetoes use of 3% of lottery proceeds to help the events and tourism sector

Law 14,148/21, which created a recovery plan for the events and tourism sector in Brazil, was sanctioned and came into force this Wednesday (4). The Emergency Program for the Resumption of the Events Sector (Perse) foresees a series of actions to compensate loss of firms of the sector due to the pandemic. President Jair Bolsonaro removed the possibility of using 3% of the money collected from Caixa lotteries and Lotex, together with funds from the issuance of Treasury bills, to cover the benefits given to the sector.

Law 14.148 / 21, which creates the Emergency Program for the Resumption of the Events Sector (Perse), came into force on Wednesday (May 4) with measures to compensate the loss of revenue of companies due to the COVID-19 pandemic.

Perse program benefits companies that hold or market events in general (such as concerts, business fairs and congresses), concert halls, buffets, nightclubs, hotels, tourist agencies and cinema theaters.

Among the measures envisaged are the possibility of renegotiating tax and non-tax debts, including a discount of up to 70% on the total amount of the debt.

The President of the Republic vetoed a series of financial measures to support the events sector, such as tax exemptions and indemnity for companies that had a turnover drop of more than 50%. In his justification, the President stated that some measures would affect public accounts and others would disregard fiscal rules.

Among the vetoes, it is highlighted Item I of art. 5th and art. 19 that dealt with the use of 3% of the money collected from the Caixa lotteries and Lotex, together with resources from the issuance of Treasury bills, to cover the benefits given to the sector.

In his message to the President of the Senate, Bolsonaro communicates the reasons for the veto:

"The legislative proposal establishes as possible sources of funds to be used to fund its proposals, in addition to the resources of the National Treasury: the proceeds from the collection of lotteries dealt with in articles 15, 16, 17, 18 and 20 of Law No. 13,756 , 2018.

Although worthwhile, the proposal affects the National Penitentiary Fund (Funpen) and the Public Security Fund (FSP), reducing their budget allocation and, thus, compromising their dependent public policies, for which it would be up to the legislator to present compensatory measures capable of to rule out this injury, which did not occur, in violation of art. 16 of Complementary Law No. 101, of 2000 (LRF) and art. 125 and 126 of Law No. 14,116, of 2020 (LDO / 2021), as well as not having demonstrated whether or not there is compatibility with Constitutional Amendment 95, of 2016, under the terms of art. 107 to 114 of the ADCT.

Finally, the proposal may lead to a decrease in the value of the prize money for lottery products, which causes a reduction in the total collection obtained with the exploitation of these, generating a reduction in the prize money, damaging the other legal beneficiaries, once the number of bets falls, reducing the funds raised, making it lose the attractiveness of the award, impacting the beneficiary chain, including impacts on the Public Finance, which is favored by the collection of income tax on the award, even if, in this case, only in fiscal year 2021."


In all, the law suffered nine vetoes. All of them will be analyzed in a session of the National Congress, to be scheduled.
