Maranhão lottery has public notice suspended by the State Court of Auditors

The Court of Auditors of Maranhão determined the suspension of the Accreditation Notice of Mapa – Maranhão Partnerships, which would select companies to operate and explore the state’s lottery Lotema. The decision was made by Councilor Edmar Serra Cutrim, based on a presentation of Intralot Brasil, who questioned possible irregularities in the public notice and requested that the text be adapted to the legal norms that deal with the concession of public services.

Councilor Edmar Serra Cutrim, of the Court of Auditors of Maranhão, yesterday (10) determined the suspension of the Accreditation Notice of Mapa – Maranhão Partnerships, which would accredit companies for the operation and exploitation of the Lotema – Lottery of the State of Maranhão.

The decision complied with a request from Intralot Brasil, which questioned a possible irregularity in the public notice, which would not meet the legal norms that deal with the concession of public services.

Intralot's representation points to a violation of Law 8987, which deals with concessions, due to the fact that the public service cannot be delegated to the private sector through an accreditation bidding procedure. In addition, Intralot points out that the grant charged from the accredited by way of transfer would affect the planning and consequently the interest of eventual participants.

The Counselor determined that Mapa be notified and inform the Court of Auditors, within two days, of the measures adopted to comply with the measure and, within five days, present a defense on Intralot's questions, which since December had already been asking for the impugnation of the public notice and the suspension of the accreditation process, as it understood that accreditation would not be the best model for the event.

According to the company, the lottery service would not fit into the infeasibility of competition and that several companies would be able to participate in a bidding dispute for the granting of services.
