Brazilian Justice issued first sentence on match-fixing in football

The first convictions for manipulation of results in football games in Brazil has been issued. The Court of Justice of the State of São Paulo (TJ-SP) condemned 11 people who acted between May 2015 and May 2016 for interfering in games of the A2 and A3 series and sub-20 of the Paulista Championship, and also in matches of the North East reigon. The defendants were sentenced to 10 years and 8 months in prison.

The complaint was made by the STJD (Superior Court of Sports Justice) after detecting inconsistencies when analyzing the betting patterns in the duel between Atlético Sorocaba and Santo André, on September 27, 2015.

The research process was prepared by an audit and the documents pointed out that the bets were inconsistent, and that there could be manipulation of results. The investigation was aimed at club directors and match referees.

In December 2015, in hearings by the president of São José Esporte Clube and the directors of Tupã Futebol Clube, they reported the offer, by unknown agents, of sums of money, so that clubs would lose certain football games, related to the A3 and sub-series. 20 of the Paulista Championship.

In the decision, Judge José Steinberg highlighted that the participation of all defendants in the crime under analysis was very clear and demonstrated by the evidence collected.

“Each one of them had a specific action for the crime to be consummated, that is, there was a whole chain of collaboration, so that it was possible to manipulate the results, with the obtaining, by all, of undue patrimonial advantage, in the exact terms of article 41-D, of the Fan Statute,” he pointed out.

The members of the gang were sentenced to 10 years and 8 months in prison.

According to the lawyer specializing in sports law and partner at Corrêa da Veiga Advogados, Luciano Andrade Pinheiro, the development of the sports betting environment in Brazil gives rise to criminals who manipulate the results of matches to defraud the houses that organize the bets.

"Decisions like this are important to curb the practice, which is harmful and condemned worldwide," highlights the expert.
