“It's key to debate in BiS on states and municipalities competences to have their own lotteries”

Lawyer Roberto Brasil Fernandes, one of the leading experts on lotteries in Brazil, will be present at the Brazilian iGaming Summit as a speaker on one panel and moderator on another. At the event, he intends to address the current stage of the sector in Brazil and the different competences of the Union, States and Municipalities for the establishment of their own lottery modalities and the legal uncertainty of municipal lotteries.

Lawyer Roberto Brasil Fernandes, head of the law firm that bears his name and one of the greatest Brazilian authorities on the subject of lotteries, will have an outstanding participation in the Brazilian iGaming Summit. In addition to moderating a panel on good practices in the exploration of lottery modalities in the country, he will discuss the legal aspects of the activity and sports betting.

He has already told GMB his concern about the legal uncertainty of the municipalities that are proposing municipal lotteries. For him, it is commendable that cities want to explore the activity to guarantee resources for social application, but the activity is not foreseen in the decision of the Federal Supreme Court. He recommends that municipalities seek such resources from state governments or the Union. This will be one of the topics he will address in BiS.

 



GMB – What will be the main topics that you intend to address in your lecture and what is your vision of the current moment of the gaming and betting sector in Brazil?
Roberto Brasil Fernandes –
The different competences of the Union, States and Municipalities, regarding the institution of their own lottery. With emphasis, the legal uncertainty of the “Municipal Lotteries”.

How do you analyze Brazil's growth in the sports betting segment, still in the process of regulation, and how do you believe that the activity will be explored in time to take advantage of the Qatar World Cup?
It will be a market that will be born (after authorizations or concessions) large. One of the biggest in the world. I believe that the exploration will be through the “authorization” institute, with several operators in the national market, and that it will happen very soon.

At what point do you see the local gaming market in general and its evolution from a political and regulatory point of view?
The approval of Bill 442/91 by the Chamber of Deputies should be greatly celebrated, but there is still a long way to go before it becomes a business opportunity. Perhaps the decision of the Supreme Court on General Repercussion 966177 can shorten this process. I emphasize at this point that whatever the path, if there is not good (optimal) regulation (fiscal and tax, administrative and criminal aspects), the market may suffer another setback (as happened with bingos in Brazil).

Are the results of your law firm's work this year as expected? Do you have plans to grow in Brazil and contribute even more to the local market?
Yes, the results were very good. Both in the service to the lottery and gambling sector (regulatory and consulting), which represents 30% of our revenue, as well as to the other sectors in which we operate (business law), the online service met expectations. Perhaps because we have already adopted this practice - home office - well before the pandemic.

With the regulation of sports betting, do you believe that the other gaming verticals could gain a reinforcement for their legalization in Brazil?
If it is good regulation, with the adoption of good practices, YES; otherwise, it may be a barrier.

For the second year, the Brazilian iGaming Awards will recognize the most outstanding in the sports betting and iGaming sector in the Brazilian market in 14 categories, on the first day of BiS 2022, in Sao Paulo.

About the Brazilian iGaming Summit and Afiliados LATAM

Sao Paulo, the largest business hub in Latin America, will host the second edition of the Brazilian iGaming Summit on the 28th and 29th of June.
