Decree regulates the Lottery and sports betting in the State of Mato Grosso do Sul

The State Government regulated Law nº 5.720/2021, which provides for the Lottery of the State of Mato Grosso do Sul. According to decree nº 15.952, published this Friday (3) in the Official State Gazette, the execution will be in charge of the State Department of Finance. According to the document, Sefaz will be able to immediately explore the service, initially via accreditation of lottery operators, 'until the competent body for analyzing partnerships in general of the State Administration indicates the legal model to be definitively followed in its exploitation.'

The Lottery Superintendence of the State of Mato Grosso do Sul will be created within the administrative structure of Sefaz, which will have the power to directly or indirectly explore the public lottery service, in compliance with federal legislation.

The exploitation of lottery modalities by the States is considered a public service and the resources obtained must be destined to programs in the areas of social security, housing, sports, education, health, social development, culture or public security.

The public services of the Lottery may be exploited through concession, permission, authorization or other forms of contracting or partnerships, provided for by law, in compliance with the rules and regulatory acts.

By the decree published this Friday (3), Sefaz will “immediately exploit this public service by the State Department of Finance, initially via accreditation of lottery operators, until the competent body for the analysis of partnerships in general of the State Administration indicates the modeling to be definitively followed in its exploitation.”

Sefaz may enter into agreements with other public bodies and entities of the Union, other states or municipalities, to fulfill its purposes. The immediate operation of the service will be the responsibility of Sefaz, through the accreditation of interested parties to request and comply with the normative and lifetime requirements of the modality.

Modalities

The State Lottery will have six types of lottery products created and approved according to the regulation:

I - Passive lottery mode: betting system in which the bettor buys the ticket already numbered, in physical (printed) or virtual (electronic) media;

II - Numerical prediction contest mode: betting system in which the bettor tries to predict which numbers will be drawn in the contest;

III - Specific predictive contest modality: betting system established by federal law No. 11,345, of September 14, 2006;

IV- Mode of sports predictions: betting system where the bettor tries to predict the outcome of recent sporting events;

V- Instant result lottery mode: system that immediately displays whether or not the player has been awarded a prize;

VI - Fixed-odds sports prediction mode: related to real sports-themed events, in which it is defined, at the time of placing the bet, when the bettor can win if the prediction is correct.

All the rules of each of the lottery modalities will be made available on the Sefaz website. In compliance with control practices against gambling, the authorized or licensed operator must create customer service channels.

The forecast for the allocation of revenue to the State, as royalties on the exploitation rights, must be in a percentage of not less than 12%, levied on the net operating revenue of the lottery service, referring to lottery products of all types, with the exception of the fixed quota modality, where the percentage will be 5%.

Each lottery product will have its draw dynamics previously described in the product, considering the set of rules that define the quantity and price of bets, the quality and value of the prizes, the expected period of circulation, the probability of winning, means of commercialization etc.

Destination

The decree also provides that the net revenue obtained from the exploitation of the public service will have the following destination:

- 50% to finance programs in the area of housing;
- 25% to social security;
- 25% to programs in the areas of sport, education, health, social development and investments in public security, in equal parts.
