The São Paulo State Court of Auditors (TCE) followed the advice of counselor Cristiana de Castro Moraes and ordered the cancellation of the international competition that would choose a company to explore lottery modalities at the state level. The contract has an estimated value of R$ 1,041,334,628.86 (US$ 190m).
The board members agreed with the understanding of Cristiana, the rapporteur, who in March suspended the auction, which would take place on the São Paulo Stock Exchange (B3), and who pointed out the “need for a broad review of the economic-financial feasibility study” of the concession.
For the counselor, a “document that fully and appropriately consolidates the assumptions and data of the concession must be prepared, from which a project can be extracted, duly grounded, to guide the formulation of proposals.”
"In view of the magnitude of the failures observed in the conception of the concession, the continuity of the procedure in the molds designed by the State Administration is unfeasible, which imposes the determination of deconstitution of the event, under the terms of article 49 of Federal Law No. 8.666/93,″ pointed out the counselor in her vote.
The public notice for the concession of the State Social Lottery to the private sector was published in February, involving the exploration of fixed-odds betting and specific, sports, numerical, instantaneous and passive predictions. The auction would take place at B3 on March 29 and was suspended the day before by determination of the director and in response to a request for challenge made by Hebara, Madrona Advogados and the IGT/Scientific Games consortium.
The law that created the state lottery was sanctioned by Governor João Doria in July 2021, after a project by the Secretary of the Civil House was approved by the Legislative Assembly of the State of São Paulo.
