Peru moves forward with bill to regulate sports betting in the country

The Minister of Foreign Trade and Tourism of Peru (Mincetur), Roberto Sánchez, announced that the commission of that ministry approved, by majority, the prediction of Bill 2070/2021-PE, which seeks to regulate gambling and sports betting online. “The sector must be regulated in an effective manner since it has generated, in the last year, an economic movement of around US$ 1 billion, without yielding income to the national treasury,” said Sánchez.

The holder of the portfolio and a technical team from Mincetur appeared before the aforementioned commission, where they stated that the Executive's proposal goes hand in hand with successful models at an international level, encouraging investments within the framework of responsible gaming policies.

Remote gambling and sports betting must be regulated effectively as they have generated, in the last year, an economic movement of around US$ 1 billion, without yielding income to the national treasury,” said Sánchez.

The Executive Bill states that the Mincetur is the entity responsible for granting authorizations for the use of technological platforms in betting and sports betting, as well as in physical premises, for which companies must be registered in the Single Registry of Taxpayers.

In the same way, the constitution of guarantees in favor of the State is established to cover the payment of fines and prizes, in addition, a direct tax applied to the Net Income (Net Win) of 12% (same percentage as the casino activity and slot machines), among others.

The proposal states that the control of technological platforms will be carried out by physical or logical, face-to-face or remote access. In addition, the participation in remote sports betting of minors and people with gambling problems, identified through the Registry of Persons Prohibited from Accessing Casino Games and Slot Machines, is prohibited.

In the same way, the project establishes that of the 100% collected from Gaming Tax, 40% of the collection will go to the public treasury, the remaining 20% goes to the Peruvian Sports Institute (IPD) and 40% to the Mincetur.

"It is vital that these types of games are carried out with integrity, honesty, transparency and equal treatment, protecting vulnerable groups and preventing the activity from being used for computer crimes, fraud and other illicit acts," concluded Sánchez.
