Project that creates municipal lottery divides opinions in Cuiabá’s Chamber

A bill that creates the public Lottery service in the municipality is pending in the Chamber of Cuiabá, in Mato Grosso state. Mayor Emanuel Pinheiro's (MDB) proposal has been in the House since December last year and still divides the councilors' opinions. The project received a favorable opinion from the permanent committees of the legislature and was scheduled to be voted on yesterday (11), but a request for a view postponed the debate.

According to the text of the article, the resources raised from the activity will be destined for social assistance, sports and actions to combat covid-19. In addition to the health and social consequences, the mayor highlights that the coronavirus pandemic has also brought economic consequences.

When defending the implementation of the Municipal Lottery, Pinheiro cites a decision of the Federal Supreme Court (STF) that understood that the Union does not have exclusivity in the exploitation of lotteries. However, only the Federal Government operates lottery services in the country, through Caixa Econômica Federal (CEF).

“The Lottery provided for in the Bill, in addition to being a tool capable of increasing municipal revenue, has the potential to finance and promote areas such as Social Assistance, Sports, Culture and Health. In addition, the proposal includes that part of the lottery revenue is for the cost of its operation, thus not having an increase in expenses without the proper financial backing,” says an excerpt of the justification.

Discussions

The proposal received a favorable opinion from the permanent committees of the Chamber and was scheduled to be voted on at the session this Thursday, August 11, but a request for a view postponed the debate.

Before that, parliamentarians from the independence bloc criticized the matter. Sergeant Joelson (PSB) asked councilors and citizens to do research on the link between the lottery and organized crime.

“A simple search, just Google this text: lotteries and organized crime. You will see how much activity you will find across Brazil linking the lottery to organized crime," he said.

Eduardo Magalhães (Republicans) was against the idea. He commented that the councilor has difficulty inspecting the acts of the Executive and questioned who will inspect the lottery service.

“We were not able to inspect what we have today. Who will oversee this? It is a mistake. In several municipalities in Brazil, where they invented this business, there was only corruption, only jail, Federal Police at the door. It just adds to the confusion,” he said.

Demilson Nogueira (PP) said that he intends to present an amendment to the matter so that the services are performed only by the municipality, to facilitate the inspection of its activities.

“We need to know what the interest in this lottery is, who is going to exploit it. I will present, if possible, an amendment proposal so that, if approved, it will be explored by the City Hall. What's the point in outsourcing it there? What's the point?” he asked.

The leader of the municipal government, councilor Adevair Cabral (PTB), came out in defense of the project, claiming that it is not unconstitutional and cited that there is already a favorable manifestation by the commissions that analyzed its legality.

“The Federal Supreme Court has already given cause for gain to the Municipalities and States. It is authorized to hold lotteries so as not to let Caixa Econômica only take care of it and the football teams to collect money from the municipalities. I don't see anything wrong with that. For the prefecture, nothing can. Other municipalities, everything can, the federal government can, Caixa Econômica can, football teams can," he said.
