As established in Interministerial Ordinance 28/2024, of May of this year, the Secretariat of Prizes and Betting (SPA) will be responsible for analyzing all betting license applications in Brazil, followed by approval from the Ministry of Sports. In the event of a difference of opinion, the Attorney General's Office will be responsible for deciding on each case.
With this, the National Secretariat of Sports Betting was established within the Ministry of Sports, to analyze license applications after evaluation by the SPA. Now, with the publication of Ordinance 98/2024, the procedure for issuing approval from the Ministry of Sports on license applications for the commercial exploitation of sports betting and online gaming was established.
The new ordinance establishes that the Directorate of Monitoring and Evaluation of Sports Betting is responsible for establishing and coordinating a technical team to analyze the applications. This technical team will be composed of 3 members: a director, who will coordinate it, a general coordinator of the Monitoring Department and another general coordinator of the Integrity Department.
By means of the ordinance, the National Secretary of Sports Betting may submit for approval by the Minister of Sports the appointment of other employees of the Department to form the technical team.
The technical team is responsible for issuing opinions on license requests, while the Monitoring and Evaluation Department is responsible for conducting the initial examination of the authorization request, requesting additional clarifications from the SPA and recording the technical team's decision in the Betting Management System (Sigap).
