Goiás Court of Auditors maintains suspension of municipal lottery bidding in Goiânia

The Goiás Court of Auditors ratified this Wednesday (11) Precautionary Measure 18/2024, which suspended the bidding process of the City of Goiânia for the contracting of a company that would operate the municipal lottery service. In his vote, in addition to the evidence of irregularities, councilor Fabrício Motta considered that the current administration is ending and a new contract, to be fulfilled by the new municipal administration, “would not be legitimate.”

The precautionary measure was issued last Friday (6), following reports of irregularities filed by a company interested in the bidding process. According to the complainant, the notice contained flaws in the disclosure and in the requirements for technical and financial qualification.

In his vote, in addition to the evidence of irregularities, councilor Fabrício Motta considered the fact that the current administration is ending and a new contract, to be fulfilled by the administration that begins on January 1st, “would not be legitimate.”

The vote also states the lack of a Terms of Reference or Basic Project in the notice or on the Transparency Portal, which is contrary to federal legislation. Other problems detected were the presence of subjective judgment criteria, such as the requirement for “best methodology” or “technical knowledge”, without due technical justification or clear parameters for evaluation.

It also drew attention to the fact that, between the request for publication and the publication of the bidding notice, only two days passed, that is, the entire process took place between November 19 and 21.

The bidding process, scheduled to take place last Monday (9), aimed to hire a company to manage and control the municipal lottery for a period of 10 years, with an estimated gross revenue of R$43.2 million (US$7.15m) for the first year. The amount was calculated based on an analysis of the national market and international experiences.

The bidding process was “lowest price”, but the company that offered the highest percentage of funds to the municipality would be considered, with a minimum of 51.33%. The types of games planned included the purchase of numbered tickets, sports betting, choosing numbers for the draw and instant prizes.

With the approval of the precautionary measure by the Plenary, the City of Goiânia has 15 (fifteen) days to present its defense. After this period, the documents will be sent for analysis by the External Contracting Control Department.
