In order to comply with the preliminary decision determined in Direct Unconstitutionality Actions 7721 and 7723, of the Federal Supreme Court, the Prize and Betting Secretariat (SPA) of the Ministry of Finance issued this Friday (6) Ordinance SPA/MF No. 1,902, which provides for the immediate application of rules provided for in Ordinance 1,231.
The Ordinance defines the immediate application of items XVI, XVII, XVIII and XIX of art. 12, which prohibits communication, advertising and marketing actions for fixed-odds lottery bets aimed at children or adolescents or that have this audience as their target audience.
The new document also prohibits them from being broadcast in the media or in programs where people under eighteen years of age constitute the main audience or on websites with an audience profile of minors.
The use of images of children and adolescents or elements that are particularly appealing to those under eighteen years of age is also prohibited. Furthermore, the rule prohibits the communication of bets from being associated with cultural activities for children and adolescents.
From now on, any type of advertising, publicity and marketing communication by bets, in any medium, will start to adopt the age restriction warning with the symbol 18+. Or the warning that it is “prohibited for minors under 18 years of age.”
The rules for inspection, monitoring and sanctions for non-compliance with the provisions indicated in the caput, including those provided for in articles 19, 21 and 22, will be implemented by the SPA immediately.
The others will be inspected, monitored and sanctioned by SPA from January 1, 2025.
