Loterj wants to take down betting websites without a license to operate in Rio de Janeiro

Loterj, the Government body of Rio de Janeiro responsible for the management of State lotteries, filed an action to require a court order determining Anatel – Brazil’s National Telecommunications Agency  to take down thee sites of betting houses that have not obtained a state license.

The initiative is seen as one of the organization's attempts to hinder the operation of sports betting and online gaming sites in the area of Rio de Janeiro.

Caio de Souza Loureiro, partner in the Gaming & eSports area of TozziniFreire Advogados, states that there is no legal basis for the request.

“There is no legal basis for the request, because it is based on State Decree, which can never be overridden by Federal Law. As a measure is more than one attempt by the Loterj to trap the platform of federal regulation,” says Loureiro.

Furthermore, Loureiro highlights that the Supreme Federal Court (STF) determined the breaking of the Union's monopoly and allowed the States to also explore the lottery services (which bets are a species).

“It is clear to the Union's primacy to legislate on the matter,” he says.

In response to Loterj's request, Justice determined that the Federal Prosecutor's Office take a position on the case before issuing a decision.
