The ordinance establishes the application criteria and procedures for monitoring funds from lottery revenues collected from numerical predictions and fixed-odds bets transferred to the State and District Departments of Sports or equivalent agencies, according to the percentages established in Laws 13.756 and 14.790, which address this topic.
A Permanent Regulatory and Monitoring Committee (CPRM) was established to oversee funds from lottery revenues collected from numerical predictions and fixed-odds bets transferred to the implementing units. The CPRM will be composed of representatives from the following units of the Ministry of Sports:
I - Projects Directorate (DPROJ), which will coordinate it;
II - National Secretariat of Amateur Sports, Education, Leisure, and Social Inclusion (SNEAELIS);
III - National Secretariat of Football and Defense of Fan Rights (SNFDT);
IV - National Secretariat of Sporting Excellence (SNE);
V - National Secretariat of Parasports (SNPAR);
VI - National Secretariat of Sports Betting and Economic Development of Sports (SNAEDE);
VII - Brazilian Doping Control Authority (ABCD);
VIII - Certification Directorate (DCERT);
IX - Special Advisory for Internal Control (AECI);
X - Ombudsman's Office (OUV);
XI - General Coordination of Budget, Finance, and Accounting (CGOFC); and
XII - General Coordination of Accountability (CGPC).
The CPRM is responsible for:
I - develop and periodically review the application criteria and monitoring procedures for sports promotion resources transferred to the implementing units;
II - deliberate on the compliance of the application plans with the application criteria set forth in the ordinance;
III - deliberate on the partial and final financial statements submitted by the implementing units, issuing a technical opinion regarding their approval, with or without reservations, or disapproval;
IV - prepare due diligence, notifications, or technical recommendations to the implementing units;
V - request information from the operating agent and financial institutions regarding the resources derived from the proceeds of lottery collections based on numerical predictions and fixed-odds bets;
VI - collaborate with oversight, auditing, or external control activities;
VII - establish flows and procedures for monitoring and reporting resources, preferably using technological tools and electronic forms; and
VIII - evaluate and deliberate on requests for reconsideration submitted by the implementing units.
The funds from the proceeds of the numerical prediction lottery, allocated to the Ministry of Education and transferred by the operating agent to the implementing units, must be applied in accordance with the provisions of Law No. 13,756, regarding priority allocation to the holding of Olympic and Paralympic School Games at the state and district levels.
The ordinance also allows for allocation to activities related to school sports, facility maintenance, and support for sports for people with disabilities, among others.
The implementing units that receive funds from the proceeds of the numerical prediction lottery and fixed-odds bets are required to report on the implementation of their investment plans, as provided in the ordinance, twice a year: a partial report by July 20th and a final report by January 20th of the following year.
