Andradina municipality moves ahead, approving casino operations if Brazil legalizes gambling

The City Council of Andradina, municipality of the state of São Paulo, approved the bill submitted by Mayor Mário Celso Lopes, which became Law 4,316/2025, authorizing the concession of casino game operations to private initiative for tourism purposes. The initiative is inspired by Bill 2,234/2022, which is still pending in the National Congress and has not yet been definitively approved. The text will only have practical effect if the Bill becomes law.

The municipal text, published in the Official Gazette, declares as being of “relevant tourist and social interest” the services related to the operation of games regulated by the federal bill, especially those carried out in casinos integrated into high-end resorts.

Among its key points, the law allows the municipal Executive Branch to conduct a bidding process under the competitive dialogue modality — provided for in Federal Law No. 14,133/2021 — to grant private companies the operation of casinos and regulated games.

The regulation also authorizes the installation and operation of casinos within tourist developments, covering roulette, card games, electronic games, and similar activities, as well as ancillary services such as gastronomy, lodging, and entertainment.

However, the text will only have practical effect if the federal bill is enacted into law. Article 3 of Law No. 4,316/2025 conditions its effectiveness on the national approval of the proposal or an equivalent regulation governing the operation of games and casinos in Brazil.

“The effectiveness of this Law is conditioned upon the conversion of Bill No. 2,234/2022 into Federal Law,” reads the section signed by the mayor.

Currently, Bill 2,234/2022, which seeks to legalize gambling in the country, has only been approved by the Senate’s Committee on Constitution, Justice and Citizenship (CCJ) and still needs to pass the Senate plenary before proceeding to presidential sanction.

Even so, Andradina is getting ahead of the federal debate and becoming one of the first cities in Brazil to authorize, through local legislation, the granting of gaming service concessions in the event that national regulation comes into effect.
